Consumers who signed a lease with Home Partners Holdings LLC or whom the lease listed as an occupant or household member may qualify to claim a cash payment from a class action settlement.

Home Partners Holdings LLC, along with OPVHHJV LLC (doing business as Pathlight Property Management) and related companies, agreed to pay $34 million to settle a class action lawsuit. The lawsuit alleged Home Partners used misleading, unenforceable or otherwise unlawful lease provisions, particularly regarding repair and maintenance obligations.

Who is eligible for a Home Partners payout?

Class members must meet any of the following criteria:

  • They are or were a party to a lease with Home Partners in any state or the District of Columbia (except Minnesota, Washington or Colorado) at any time from Dec. 22, 2019, through July 31, 2025.
  • They are or were a party to a lease with Home Partners in Minnesota from March 1, 2016, through July 31, 2025.
  • They are or were a party to a lease with Home Partners in Washington from Sept. 21, 2016, through July 31, 2025.
  • They are or were a party to a lease with Home Partners in Colorado from May 1, 2017, through July 31, 2025.
  • They are or were a household member or occupant listed on such a lease and occupied the home during the applicable period.

How much can class members receive?

  • Pro rata base payment: Every lease household is eligible for a share of the net settlement fund, which the settlement administrator calculates based on the total monthly base rent each household paid compared to the total all class members paid.
  • Repair and maintenance cost reimbursement: The settlement allocates up to $7.5 million to reimburse class members for out-of-pocket repairs that should have been Home Partners’ responsibility. Each lease household may claim up to $2,500 for unreimbursed repairs, provided it submits supporting documentation. If total approved claims exceed $7.5 million, the settlement administrator will reduce payments proportionally. If total approved claims are less than $7.5 million, the settlement administrator will add the remainder to the pro rata base payments.

Each group of people listed on a lease is considered a “lease household.” If a lease household has multiple class members, the settlement administrator will split payment equally among them. If a former resident has an outstanding balance, the administrator will apply the payment to reduce that balance first. If the payment exceeds the balance, the administrator will pay the rest to the resident.

The settlement administrator sent notices to all individuals for whom Home Partners has a valid email or mailing address. This includes minor children listed on a lease. The settlement administrator will address any payment for a minor to all lease household members, and a parent or guardian may cash the check, if needed.

How to claim a class action payment

Most class members do not need to take action to receive the pro rata base payment; the settlement administrator will distribute it automatically after the court grants final approval.

However, to claim additional reimbursement for repair and maintenance costs, class members must submit an online claim form or download a PDF claim form to print, complete and mail to the settlement administrator. Current residents who wish to receive a check instead of a rent ledger credit or former residents whose address changed should also submit a claim form. The claim form deadline is Oct. 27, 2025.

What information is required to submit a claim?

  • To claim repair and maintenance reimbursement, class members must provide documentation, such as receipts, invoices or financial statements showing the amount they spent. They may submit self-prepared documents like handwritten receipts or photos as clarification, but these are not sufficient alone.
  • To file a claim online or by mail, class members must provide the settlement claim ID from their email or postcard notice. Those who cannot locate their settlement claim ID or postcard notice should email info@HPASettlement.com for assistance.

Payout options

  • Current residents will receive a credit to their rent ledger unless they request a check using the claim form.
  • Late-term residents (less than 60 days left on lease) may also request a check unless they owe more than three months’ rent.
  • Former residents will receive a check with payments first applied to any outstanding balance, if applicable.
    • If a former resident’s balance is with a collection agency, the payment will reduce the debt.

$34 million settlement fund breakdown

The $34,000,000 settlement fund includes:

  • Settlement administration costs: $200,000 (estimated)
  • Attorneys’ fees: Up to $11,300,000
  • Attorneys’ expenses: Approximately $1,175,000
  • Service awards to class representatives: $105,000 total (ranging from $5,000 to $12,500 per representative)
  • Payments to eligible class members: The remainder of the fund (with $7.5 million set aside for repair and maintenance cost reimbursement)
