Labcorp Workers' Comp Class Action Settlement

Consumers who received laboratory services from Labcorp between Aug. 28, 2013, and Aug. 28, 2015, related to a workers' compensation claim yet still received a bill may qualify to claim $125 from a class action settlement.

Laboratory Corp. of America (Labcorp) agreed to a class action settlement to resolve a lawsuit alleging improper billing and collection practices for workers’ compensation laboratory services.

Who can file a claim Labcorp workers' compensation claim?

Class members must meet all of the following requirements:

• They received a laboratory service from Labcorp between Aug. 28, 2013, and Aug. 28, 2015.
• A workers’ compensation insurance carrier covered the service.
• They provided information to Labcorp showing the service pertained to a workers’ compensation claim.
• More than five business days after Labcorp received this information (unless it was provided on the initial intake form, in which case there is no time limitation), Labcorp made efforts to collect payment for the laboratory service. Collection efforts include:
• Sending billing statements
• Sending collection letters
• Making telephone calls
• Referring the bill to a third-party collection agency
• Reporting the bill to a credit bureau

How much is the Labcorp payout?

Labcorp will pay each validated class member who submits a timely and complete claim a single payment of $125. The amount is fixed and does not depend on the number of claims submitted.

How to claim a workers' compensation class action rebate

Class members can file a claim online or download and print the PDF claim form to complete and mail to the settlement administrator. The claim deadline is Sept. 30, 2025.

Information required

• To file an online claim, class members must provide the Claim ID and PIN located on their mailed notice.

• To mail in the claim form, class members must provide their Social Security number of taxpayer identification number.

Payout options

Payments to eligible claimants will be provided by paper check and mailed to the address provided on their claim form.

Labcorp workers' compensation settlement fund breakdown

The settlement fund covers:

• Settlement administration costs: To be determined (paid by Labcorp and not deducted from class member payments)
• Attorneys' fees and costs: $327,500 (paid by Labcorp and not deducted from class member payments)
• Service award to class representative: Up to $7,500 (paid by Labcorp and not deducted from class member payments)
• Payments to eligible class members: The remainder of the fund

When is the Labcorp payout date?

Payments to eligible claimants will be issued 60-90 days after the Court grants final approval of the settlement and any appeals are resolved.

Why did this class action settlement happen?

The class action lawsuit alleged Labcorp attempted to collect payments directly from individuals for laboratory services that should have been billed to workers’ compensation insurance carriers. The complaint was based on the Florida Consumer Collection Practices Act.

Labcorp denies any wrongdoing but agreed to settle the case to avoid further litigation and provide compensation to affected individuals.
