
Consumers who received a notice from EyeMed Vision Care informing them a June 2020 data incident affected their personal and protected health information may qualify to submit a claim for up to $10,000 from a class action settlement.
EyeMed Vision Care agreed to pay $5 million to settle a class action lawsuit alleging it failed to adequately protect customer data, resulting in a data breach by an unauthorized third party. The breach exposed sensitive information, such as names, contact details, dates of birth, health insurance account and identification numbers, Medicaid or Medicare numbers, driver’s licenses and other government identification numbers.
Who is eligible for a data breach payout?
Class members are individuals residing in the United States who received a notice from EyeMed alerting them that the 2020 cybersecurity incident may have compromised their personal data.
How much will the settlement payment be?
Class members can submit a claim to receive one or more of the following benefits:
- Pro rata cash payment: An estimated $50 cash payment. The settlement administrator will determine the final amount by the number of claims filed.
- Lost time: Up to four hours of time spent dealing with issues related to the data breach calculated at $25 per hour for a maximum of $100.
- Out-of-pocket expenses: Up to $10,000 for actual, unreimbursed out-of-pocket losses. This includes losses from fraud or identity theft, professional fees, costs for credit monitoring, expenses related to freezing or unfreezing credit, and other reasonable expenses traceable to the data breach.
How to claim a class action rebate
To receive a settlement payment, class members must submit a claim by the deadline of Dec. 11, 2025. They can file their claim in two ways:

- Download, print and mail the PDF claim form to the settlement administrator

Required proof and claim information
- To submit a claim online or by mail, class members must provide the class member ID from their settlement notice.
- Out-of-pocket expenses claims require supporting documentation, such as receipts, bank or credit card statements, correspondence with financial institutions, police reports or other official documents showing proof of fraudulent charges or identity theft related to the data breach.

$5 million data breach settlement fund
The $5,000,000 settlement fund will include:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $1,666,666.66
- Attorneys' expenses: Up to $50,000
- Service awards to class representatives: Up to $2,500 each for three representatives ($7,500 total)
- Payments to eligible class members: Remaining settlement funds

When is the EyeMed Vision Care settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 60 days after the court grants final approval of the settlement.
Why did EyeMed Vision Care agree to this settlement?
The class action lawsuit alleged EyeMed Vision Care failed to use appropriate data security measures, resulting in a data breach in June 2020. The plaintiffs claimed unauthorized third parties accessed sensitive personal information, causing potential harm.
EyeMed denies all allegations but agreed to settle to avoid the expense and uncertainty of continued litigation and the possibility of a trial.
