
Texas residents who received a data breach notification letter from ESO Solutions Inc. could be eligible to claim up to $5,000 or a pro rata cash payment from a class action settlement.
ESO Solutions agreed to pay $757,500 to settle a class action lawsuit alleging a September 2023 cyberattack compromised sensitive information.
Who can file a claim?
Individuals must meet both of the following criteria:
- They received a notice letter from ESO Solutions regarding the data incident.
- They resided in Texas at the time ESO Solutions distributed the notice letter.
How much is the class action settlement payout?
Class members have the following benefit options:
- Reimbursement for out-of-pocket losses: Up to $5,000 per person for documented losses fairly traceable to the data incident. Eligible expenses include fees for accessing or freezing credit reports, credit monitoring costs and miscellaneous expenses such as notary, fax, postage, copying or mileage incurred on or after Sept. 28, 2023.
- Pro rata cash payment: A cash payment determined by dividing the remaining settlement fund among all valid claimants after the settlement administrator pays attorneys’ fees and costs, service awards and valid out-of-pocket claims.
How to claim a settlement payment
To receive a settlement payment, class members must submit a claim by March 12, 2026. They can file a claim online or download, print and complete the PDF claim form to mail to the administrator.

What proof or documentation is required to submit a claim?
- To file a claim, class members must provide the class member ID located on their settlement notice.
- For out-of-pocket loss claims, class members must provide documentation, such as receipts or other records, showing the costs incurred on or after Sept. 28, 2023. Self-prepared documents (like handwritten receipts) are not sufficient alone but can supplement other documentation.
- For pro rata cash payments, class members must submit a valid claim form but do not need to provide documentation of financial loss.
