Why is there a class action settlement?
The class action lawsuit alleged Progressive Direct Insurance Co. sent debt collection emails to Florida residents between 9 p.m. and 8 a.m., potentially violating the Florida Consumer Collection Practices Act. The FCCPA restricts certain communications regarding consumer debt collection during specific hours.
Progressive denies the allegations but agreed to settle the case to avoid the expense and uncertainty of litigation.
