Patients of Granite Wellness Centers who received a notice about a data security incident or who believe the Jan. 5, 2021, breach exposed their personal information may be eligible to claim up to $5,100 from a class action settlement.

Granite Wellness Centers agreed to pay $725,000 to settle a class action lawsuit alleging it failed to adequately protect patient data, resulting in the exposure of sensitive personal and health information.

Who can file a claim?

Class members must meet the following criteria:

  • They are an individual residing in the United States.
  • The Jan. 5, 2021, data security incident at Granite Wellness Centers exposed their personally identifiable or protected health information.
  • They received a notice of the data security incident from Granite Wellness Centers on or around March 6, 2021, or believe the breach affected their data and can verify their identity and class membership.

The types of personal information potentially exposed include names, dates of birth, home addresses, dates of care, treatments, treatment providers, health information, health insurance information, driver’s license numbers, medical histories, Social Security numbers and bank account numbers.

How much can class members get?

  • Documented loss reimbursement: Class members who incurred out-of-pocket expenses due to the breach can claim up to $5,000. Eligible expenses include long-distance phone charges, cell phone minutes, internet usage fees, credit report costs, credit monitoring or fraud resolution services (if purchased primarily due to the incident), expenses related to identity theft or fraud and other losses traceable to the breach. Class members must provide documentation for these expenses.
  • Alternative cash payment: Class members who do not have documented losses may claim a pro rata share of the settlement fund estimated at $750. The final amount depends on the total number of valid claims.
  • California statutory cash payment: California residents can claim an additional $100 subject to proration.

How to claim a settlement payment

Class members can file a claim online or download and print the PDF claim form, fill it out and mail it to the settlement administrator. The claim deadline is April 27, 2026.

Required proof and documentation

  • To file a claim, class members must provide the notice ID located on the personalized notice they received in the mail or via email. Online claimants must also provide the confirmation code from the same notice. Those who did not receive a notice but believe they are eligible should call 1-888-995-4054 to verify their identity and class membership.
  • To file a documented loss reimbursement claim, class members must submit documentation (such as receipts, statements, etc.) showing the amount and nature of their losses.
  • To file an alternative cash payment claim, class members need only select the appropriate option on the claim form.
  • To file a California statutory cash payment claim, class members must attest that they were a California resident during the relevant period.

$725,000 settlement fund breakdown

The $725,000 settlement fund covers:

  • Attorneys' fees: Up to $241,425
  • Attorneys' expenses: Up to $20,000
  • Service awards to class representatives: $2,000 each for five representatives ($10,000 total)
  • Payments to eligible class members: Remainder of the fund

When is the Granite Wellness Centers data breach settlement payout date?

The settlement administrator will distribute payments within 30 days of the date it processes all claim forms or the court resolves any appeals and grants final approval of the settlement, whichever is later.
