Consumers who purchased certain CVS-branded eye drop products in the United States between Oct. 1, 2021, and Oct. 25, 2023, may qualify to submit a claim in a class action settlement.

CVS Pharmacy Inc. agreed to pay $1,000,000 to resolve a class action lawsuit claiming the company recalled specific CVS store-brand over-the-counter eye drop products after the U.S. Food and Drug Administration found unsanitary conditions at a manufacturing facility in India.

Who is eligible for a CVS eye drop payout?

To qualify for payment, consumers must have purchased one or more of the following CVS store-brand eye drop products either in-store or online in the United States between Oct. 1, 2021, and Oct. 25, 2023:

How much is the no-proof payout?

Without proof of purchase: Eligible class members can claim up to three units of the above products to receive a pro rata share of the settlement fund based on the approximate retail price and time-discount rate for each product.

With proof of purchase: Eligible class members can claim the actual amount paid for each eligible product purchased (no maximum) during the class period multiplied by a time-discount rate.

How to claim a CVS class action rebate

To receive a settlement payment, class members must file a claim online or download and print a PDF claim form to complete and mail to the settlement administrator. The deadline to submit a claim is July 11,2025.

Required proof and information

  • All claimants must provide proof of valid identification. This includes a photograph or scan of a government-issued ID, such as an unexpired driver’s license or passport.

$1 million no-proof CVS eye drop settlement fund breakdown

The $1,000,000 settlement fund covers:

  • Settlement administration costs: To be determined and subject to court approval
  • Attorneys' fees and costs: Up to $300,000
  • Service award to the plaintiff: Up to $5,000
  • Payments to approved claimants: The remainder of the fund after the above deductions
