Consumers who wrote a check to pay for goods or services at any Walmart retail store in the United States may benefit from a class action settlement involving hidden check processing fees.
Walmart Inc. agreed to pay almost $2 million to settle a class action lawsuit that alleged its check-processing disclosures did not adequately inform customers about the risk of incurring multiple bank fees if the bank returned their check and the store made multiple collection attempts.
Who are the class members?
Class members are all past and future customers who wrote a check for payment of goods or services at any Walmart retail store in the United States.
What are the settlement benefits?
Walmart will provide the following injunctive relief:
- Walmart will update its posted check policy and PIN pad disclosures at every Walmart store in the United States.
- The new disclosures will clearly state that if a bank returns a check as unpaid, Walmart and its check processor, TeleCheck, may make multiple attempts to collect both the check amount and any return fees. The disclosures will also state that each attempt could result in separate bank fees from the customer’s bank.
No claim form required
Class members do not need to file a claim to benefit from this settlement.
Settlement fund breakdown
The settlement administrator will use the $1,850,000 settlement fund exclusively to pay attorneys’ fees and a service award to the named plaintiff. It will not distribute any portion of the settlement fund to class members as compensation.
Important dates
- Fairness hearing: May 13, 2026
When will the Walmart settlements benefits be available?
Walmart will implement the required changes approximately 180 days after the court grants final approval of the settlement.
Why did this class action settlement happen?
This class action lawsuit alleged Walmart’s check-processing disclosures did not adequately inform customers that multiple attempts to collect on a returned check could result in multiple bank fees. The plaintiff claimed this lack of transparency caused customers to incur unexpected fees.
Walmart and TeleCheck denied the allegations but agreed to settle to avoid the uncertainty and expense of a possible trial.
