Consumers who received a notice from Byte Federal Inc. stating their personal information was affected by a Nov. 18, 2024 data breach may qualify to claim up to $3,000 plus additional benefits from a class action settlement.

Byte Federal Inc. agreed to settle a class action lawsuit alleging it did not adequately protect personal information, leading to a targeted cyberattack on its computer systems. The lawsuit claims the breach exposed sensitive data, such as names, dates of birth, addresses, phone numbers, Social Security numbers, government-issued identification, transaction information and photographs.

Who is eligible for a Byte Federal payout?

Class members must meet the following criteria:

  • They are a living individual residing in the United States.
  • Their private information was impacted by the Nov. 18, 2024, Byte Federal data breach.

How much is the data breach payout?

  • Cash payment A – attested time spent: Up to four hours at $20 per hour for a maximum of $80. Eligible activities include:
    • Changing passwords
    • Investigating suspicious activity in accounts
    • Contacting banks or businesses about suspicious activity
    • Researching the data incident
  • Cash payment B – documented losses: Up to $3,000 for actual, documented out-of-pocket losses due to the incident. Eligible expenses include:
    • Unreimbursed losses relating to fraud or identity theft
    • Professional fees (attorneys, accountants, credit repair services, etc.)
    • Costs associated with freezing or unfreezing credit
    • Credit monitoring costs incurred after the notice of the incident
    • Miscellaneous expenses, such as notary, postage and mileage
  • Credit monitoring services: All class members are eligible for two years of credit monitoring services from a credit bureau. This includes:
    • Real-time monitoring
    • Dark web scanning with immediate notification of potential unauthorized use
    • Comprehensive public record monitoring
    • Identity theft insurance (no deductible) up to $1,000,000
    • Access to fraud resolution agents

How to claim a class action rebate

Class members can file a claim online or download, print, complete and mail a PDF claim form to the settlement administrator. The claim deadline is Aug. 19, 2025.

Proof and information required

  • To file an online claim, class members must log in with their unique ID and PIN located on the top of the settlement notification email or postcard. Those who misplaced their notice should contact the settlement administrator.
  • To claim documented losses, class members must provide receipts or other proof. Self-prepared documents are only accepted if they clarify or support other documentation.
  • To claim time spent, class members must provide a brief description of their activities.
  • To claim credit monitoring, class members must provide an email address.

Data incident settlement fund breakdown

The settlement fund covers:

  • Attorneys' fees and costs: Up to $150,000
  • Service awards to class representatives: $2,500 each
  • Credit monitoring costs: $180 per eligible claimant
  • Payments to eligible class members: The remainder of the fund after fees and awards

When is the Fisher v. Byte Federal Inc. payout date?

Payments will be distributed after the court grants final approval of the settlement and any appeals are resolved.

Why is there a class action settlement?

The class action lawsuit alleged a cyberattack on Byte Federal’s systems exposed sensitive personal information. The plaintiffs claimed Byte Federal did not adequately protect their data.

Byte Federal denies any wrongdoing but agreed to settle to avoid the costs and risks of further litigation and to provide benefits to those affected.
