Baker Drywall Partnership LLP agreed to pay to settle a class action lawsuit alleging it failed to adequately protect the personal data of individuals affected by a cybersecurity incident that occurred on or about Feb. 13, 2024.
Who is eligible for a data breach payout?
Class members are individuals in the United States that were sent a notice from Baker Drywall informing them their personal information may have been compromised in a February 2024 data breach.
How much is the class action settlement payment?
- Identity theft protection services: All class members can submit a claim to receive one year of identity theft protection with one-bureau credit monitoring and up to $1 million in identity theft insurance.
- Reimbursement for ordinary losses: Class members can claim up to $250 for out-of-pocket expenses resulting from the data breach. Eligible expenses include unreimbursed losses from fraud or identity theft, professional fees, credit freeze/unfreeze costs and credit monitoring purchased after notification of the incident.
- Lost time reimbursement: Class members can claim up to three hours of lost time spent dealing with the data breach at $25 per hour for a maximum of $75. This benefit is included in the ordinary losses $250 cap.
- Reimbursement for extraordinary losses: Class members who suffered documented and unreimbursed monetary losses due to fraud or identity theft that are traceable to the data breach can submit for up to $5,000 in reimbursement. The losses must have occurred after the data breach, and the class member must have made efforts to seek reimbursement for the loss.
How to claim a class action rebate
To receive a settlement benefit, class members must submit a claim by the Oct. 21, 2025 deadline. Class members can file a claim online or download and print a PDF claim form to mail to the settlement administrator.

Required proof and claim information
- To submit an online claim, class members must provide the notice ID and confirmation code from their settlement notice.
- Ordinary and extraordinary loss claims require supporting third-party documentation, which could include receipts, invoices for services, bank or credit card statements showing fraudulent or unreimbursed fees, police reports and other proof of identity theft or fraud due to the breach.

Settlement fund breakdown
The settlement fund for all claims and credit monitoring is not to exceed $500,000:

- Payments to approved claimants: Total determined by the number of valid claims submitted
Settlement administration costs, attorneys' fees and the service award are separate from the fund for claims and credit monitoring:
