Individuals whom Alabama Cardiology Group P.C. d/b/a Alabama Cardiovascular Group notified that a July 2, 2024, data breach may have impacted their personal or health information could be eligible to claim up to $5,000 from a class action settlement.

Alabama Cardiology Group P.C. d/b/a Alabama Cardiovascular Group agreed to pay $2,225,000 to resolve a class action lawsuit alleging it failed to adequately protect patient and employee data, resulting in unauthorized access to sensitive personal and health information.

Who can file a claim?

Class members must meet the following criteria:

  • They are individuals residing in the United States whose personally identifiable information or protected health information the July 2, 2024, data breach involving Alabama Cardiology Group potentially compromised.
  • They received a written notice from Alabama Cardiology Group regarding the data breach.

How much can class members get?

Class members may be eligible for the following benefits:

  • Expense reimbursement: Up to $5,000 for documented, unreimbursed out-of-pocket losses that are fairly traceable to the data breach. Class members must provide supporting documentation to qualify.
    • Examples of reimbursable losses include costs for credit monitoring or credit reports, late fees, overdraft or returned check fees, customer service fees, card cancellation or replacement fees, unauthorized charges not reimbursed, credit freeze or unfreeze fees, professional fees related to the breach and reasonable postage, mileage or similar expenses attributable to the data incident.
  • Cash payment: Class members may claim a pro rata cash payment as an alternative to expense reimbursement.
    • The settlement administrator will determine the amount based on the number of valid claims and the funds remaining after other settlement expenses.
  • Credit monitoring: Two years of CyEx Medical Shield Complete, which includes one-bureau credit monitoring and up to $1 million in identity theft insurance.
    • Class members may claim this benefit in addition to either expense reimbursement or the cash fund payment.

The settlement administrator will distribute the fund in the following order: settlement administration costs, attorneys’ fees and expenses, credit monitoring costs and then payments to class members.

If the number of valid claims exceeds the available funds, the settlement administrator will reduce all payments on a pro rata basis.

How to claim an Alabama Cardiology Group data breach payment

Class members can submit the online claim form or download, print and complete the PDF claim form and mail or email it to the settlement administrator. The claim deadline is March 6, 2026.

Proof or documentation required to submit a claim

  • For all claims, claimants must provide their contact information and any required claim identification information.
  • For out-of-pocket expense reimbursement, claimants must provide reasonable third-party documentation of actual, unreimbursed losses that are fairly traceable to the data breach. Self-prepared documents alone are not sufficient.
  • For cash fund payments and credit monitoring, claimants do not need to submit documentation of losses. They must attest to their eligibility and submit the claim form.

$2.2 million settlement fund

The $2,225,000 settlement fund includes:

  • Credit monitoring costs: Dependent on number of valid claims
  • Payments to eligible class members: Remainder of the fund

When is the Alabama Cardiology Group settlement payout date?

Why is there a class action settlement?

The class action lawsuit alleged Alabama Cardiology Group failed to adequately protect personal and health information, resulting in unauthorized access during a cybersecurity incident discovered on July 2, 2024.

Alabama Cardiology Group denies any wrongdoing or liability but agreed to settle the lawsuit to avoid the costs and uncertainties of litigation.
