Drivers insured by Alfa Mutual Insurance Co. in Alabama who experienced a total vehicle loss between March 13, 2018, and the present may be eligible to claim up to $24 plus any unpaid taxes from a class action settlement.

Alfa Mutual Insurance Co. agreed to settle a class action lawsuit claiming it underpaid Alabama policyholders on total loss auto insurance claims by not including certain required taxes and fees in the actual cash value payments.

Who can file a claim?

Class members must meet all of the following criteria:

  • Alfa Mutual Insurance Co. or an affiliated entity insured them under an Alabama automobile insurance policy.
  • They submitted a first-party physical damage claim for a covered vehicle that resulted in a total loss between March 13, 2018, and the present.
  • They did not receive full payment for purchasing fees (which include title, registration transfer fees and taxes) as part of their total loss claim payment.

The settlement administrator identified potential class members using Alfa’s claims data. If an individual received a notice, it means Alfa’s records indicate they may qualify. However, even if someone did not receive a notice but believes they meet the criteria, they can still file a claim.

Who is excluded from the class?

  • Individuals whose claims Alfa already released
  • Individuals who resolved their first-party property damage claims through appraisal, arbitration or a lawsuit before the plaintiff filed the settlement

How much can class members receive?

Eligible class members who submit a valid and timely claim can receive a payment of up to $24 less any purchasing fees Alfa Mutual Insurance already paid by on the original total loss claim.

Additionally, if Alfa did not pay taxes as part of the original total loss claim payment, the settlement administrator will include the unpaid sales tax in the settlement payment.

How to claim a class action payment

Class members can submit the online claim form or download and print the PDF claim form, complete it and mail it to the settlement administrator.

What proof or documentation is necessary to submit a claim?

  • If claiming for a deceased or incapacitated class member, an individual must submit supporting legal documentation showing they have the authority to receive the benefit.
  • To file an online claim, class members must provide the claimant ID and unique PIN from the postcard notice they received.

Payout options

The settlement administrator will mail payments by check to the address class members provide on the claim form.

When is the Walker v. Alfa Mutual Insurance Co. payout date?
