- You incurred monetary damages or non-monetary harms related to the cyber security incident.
The class action settlement that was previously preliminarily approved is currently stayed due to the chapter 11 bankruptcy proceedings. According to the official bankruptcy court notice, class members must submit a proof of claim in order to in order to preserve their claims.
How much will the 23andMe data breach payout be?
Settlement payment amounts have not been established. Compensation may be determined by each individual's documented monetary losses traceable to the data incident and non-economic damages such as emotional distress or mental suffering caused by the breach.
The proof of claim form allows impacted individuals to specify and request reimbursement for:
- Costs related to purchasing a physical security or monitoring system.
- Unreimbursed expenses for professional mental health counseling or treatment incurred due to the incident.
- Other out-of-pocket expenses associated with mitigating the effects of the data breach.
- Non-economic damages, such as emotional distress or mental suffering.
Former 23andMe customers may claim a specific dollar amount for each category or indicate if the amount is unknown.
How to file a data breach proof of claim
To be eligible for a payment, you must submit a Cyber Security Incident Proof of Claim by July 14, 2025. You can:
- File a claim online using the electronic filing system by 11:59pm CST.
- Download and complete the PDF claim form and mail it to the settlement administrator. Hard copies must be received by 4:59pm CST.

Law firms representing more than 25 claimants have the option to file consolidated claims. The law firm must have authorization from each claimant and should contact the Kroll claim team for specific filing instructions.
Is proof required with a claim form?
Yes, supporting documentation is required:
- Credit card statements, bank statements, invoices, receipts, or other documents substantiating unreimbursed costs, expenses, losses, or charges as a direct result of the data breach.
- For non-economic damages, a detailed description of the harm suffered is required.
The settlement administrator may request additional documentation after you file your claim. If you are unable to provide certain information at the time of filing, you may amend or supplement your claim later.
