Individuals who worked as nonexempt, hourly employees for CertainTeed Gypsum Manufacturing Inc. in Washington state between Sept. 9, 2022, and July 6, 2026, may be eligible to receive a cash payment from a class action settlement.

Saint-Gobain Adfors America Inc. and related companies agreed to pay $1,952,000 to settle a class action lawsuit alleging violations of Washington laws, including claims the companies failed to provide compliant meal and rest breaks, did not compensate employees for missed or noncompliant breaks and failed to issue accurate wage statements.

Who are the class members?

The class includes individuals who meet all of the following criteria:

  • They worked for CertainTeed Gypsum Manufacturing Inc. in Washington state.
  • CertainTeed classified them as nonexempt, hourly employees.
  • They worked at any time between Sept. 9, 2022, and July 6, 2026.

How much are settlement payments?

Each eligible class member will receive a pro rata share of the settlement fund. The amount each person receives depends on the number of weeks they worked as a nonexempt, hourly employee at CertainTeed Gypsum Manufacturing Inc. in Washington during the class period compared to the total number of weeks all class members worked.

The settlement administrator will split the payment 50% as wages (reported on a W-2) and 50% as nonwage damages, penalties and interest (reported on a 1099).

No claim form required

Eligible class members do not need to file a claim to receive a payment. The settlement administrator already has the necessary records to determine eligibility and calculate payments. It will automatically issue payments once the court finalizes the settlement.

Payout options

The settlement administrator will mail checks to the last known address on file for eligible class members unless otherwise notified. Checks will expire 180 days after issuance. Eligible class members can update their address or request payment via PayPal or Venmo by contacting the settlement administrator.

$1.95 million settlement fund breakdown

The $1,952,000 settlement fund will cover:

  • Settlement administration costs: Up to $20,000
  • Attorneys' fees: $650,666
  • Attorneys' costs and expenses: Up to $5,000
  • Service award to class representative: $20,000
  • Payments to eligible class members: The remainder of the fund
