Who can file a claim?
Individuals and entities must meet one or more of the following criteria to participate in the settlement:
- They rented an apartment or commercial unit at Westcourt Place on Nov. 12, 2019.
- They ordinarily resided in an apartment at Westcourt Place on that date.
- They were present in an apartment or unit at Westcourt Place at the time of the fire.
- They owned property in an apartment, unit or on the roof at Westcourt Place.
- They had an interest in property located in an apartment, unit or on the roof at Westcourt Place.
- They were an employee, partner, associate, officer, director or independent contractor whose business was located in the units at Westcourt Place.
- They were an insurance company that paid a class member and had a subrogated interest.
How much can class members get?
The total settlement fund is $7,300,000. After deductions for legal fees, administrative costs and other court-approved expenses, the settlement administrator will distribute funds to eligible class members according to the court-approved distribution plan.
The exact amount each class member will receive depends on several factors, including:
- The number of valid claims submitted
- The specific losses each claimant suffered
- The category of class membership (e.g., residential tenant, business owner, etc.)
- Residential tenants may claim losses related to their tenancy, property and personal injuries.

How to claim a class action payment
Class members can submit the online claim form or call the settlement administrator at 1-888-895-5219 to request a paper claim form. The claim deadline is April 30, 2026. The administrator will not accept claims after this date.
