
California Walgreen Pharmacy Services Midwest LLC or Walgreen Co. employees who worked as non-exempt pharmacy technicians between April 15, 2020, and April 20, 2024, may qualify to receive a payment from a class action settlement.
These companies agreed to pay $6.8 million to settle a class action lawsuit alleging violations of California wage and hour laws. The plaintiffs claim Walgreens did not pay overtime and minimum wages, did not provide required meal and rest breaks, issued inaccurate wage statements and more.
Who is eligible for a Walgreens settlement payout?
Employees are included in the class if they were employed by Walgreen Pharmacy Services Midwest LLC and/or Walgreen Co. as a non-exempt (hourly) pharmacy technician in California between April 15, 2020, through April 20, 2024.
There is also a subgroup of class members known as PAGA employees. Workers are considered PAGA employees if they worked as a non-exempt pharmacy technician at any California Walgreens pharmacy location between August 10, 2021, and April 20, 2024 (the "PAGA Period").
How much is the wage and hour settlement payout?
Pro Rata Cash Payment: Each class member will receive a settlement payment determined by the number of weeks worked during the class or PAGA period.
No claim form required
Class members who do not opt out do not need to file a claim to receive payment. The settlement administrator has access to employee records.
Payout options
Eligible class members will receive a paper check to the address on file.
$6.8 million Walgreens settlement fund breakdown
The settlement fund of $6,800,000 will cover the following:
- Settlement administration costs: Up to $37,950
- Attorneys’ fees: Up to $2,266,666.67
- Attorneys’ expenses: Up to $40,000
- Service award to named plaintiff: Up to $10,000
- PAGA penalties: $200,000 total ($150,000 to the California Labor and Workforce Development Agency, $50,000 to PAGA Employees)
- Payments to class members: Approximately $4,245,383.33

Why is there a class action settlement?
This class action lawsuit was filed because the plaintiff alleged Walgreens did not pay overtime and minimum wages, did not provide required meal and rest breaks, failed to issue accurate wage statements and committed other violations of California labor law. Walgreens denies any wrongdoing but agreed to settle to avoid further litigation and a possible trial.
