
Consumers who purchased one or more TreeHouse Foods frozen breakfast products in the United States for personal use (not for resale) between Oct. 18, 2024, and Sept. 2, 2025, may be eligible to claim a cash payment from a class action settlement.
TreeHouse Foods Inc. agreed to pay $4,000,000 to settle a class action lawsuit alleging negligence and violations of consumer protection laws related to its recall of certain frozen breakfast foods due to potential contamination with listeria monocytogenes.
Who can file a claim?
The settlement class includes all natural persons who purchased any covered product in the United States between Oct. 18, 2024, and Sept. 2, 2025.
Purchases must have been for personal, family or household use and not for resale.
Each household may submit only one documented claim and one undocumented claim.
How much can class members get?
The amount each class member can receive depends on whether they have proof of purchase and how many products they claim. The settlement administrator will use the $4,000,000 settlement fund to pay all valid claims, as well as administrative costs, attorneys' fees and service awards.
- With proof of purchase: Class members who submit a valid claim form with valid proof of purchase will receive the full purchase price (including taxes) for each unit of a covered product listed on their proof of purchase.
- Without proof of purchase: Class members who submit a valid claim form without proof of purchase will receive the average retail price for up to two covered products per household.
If a class member or anyone in their household previously received recall reimbursement from TreeHouse Foods, the settlement administrator will reduce their payment by the amount already received, stopping at $0.
The settlement administrator may also increase or decrease each class member's payment on a pro rata basis so the total amount paid to all claimants equals the available settlement funds or $50 per claimant, whichever is lower.
How to claim a class action payment
Class members can submit the online claim form or download, print and fill out the PDF claim form and mail it to the settlement administrator. They must submit the online claim form or postmark the PDF claim form by Dec. 16, 2025.

What proof or documentation is required to submit a claim?
Proof is required to receive the full purchase price for each covered product. Acceptable proof includes:
- An itemized retail sales receipt
- Other documents or photos (such as a retail store club or loyalty card record) showing the purchase of a covered product, the purchase price and the date and place of purchase

When is the TreeHouse Foods settlement payout date?
