Why is there a class action settlement?
The class action lawsuit alleged UC Distribution LLC, 7270356 Canada Inc. and Avanquest Software SAS enrolled California consumers in automatic renewal or continuous service subscriptions for Avanquest Software products without first presenting the renewal offer terms in a clear and conspicuous manner. The plaintiffs claimed this violated the California Automatic Renewal Law and the Unfair Competition Law.
The defendants deny all allegations of wrongdoing but agreed to settle to resolve the dispute and avoid further litigation. The settlement also requires the defendants to make changes to their subscription offer materials and website disclosures to comply with California law.
