Individuals who worked as hourly employees for Ready Pac Foods Inc., Ready Pac Produce Inc. or OTS Solutions LLC at a Ready Pac location in California between Sept. 8, 2022, and May 11, 2025, may be eligible to claim a cash payment from a class action settlement.

Ready Pac Foods Inc., Ready Pac Produce Inc. and OTS Solutions LLC agreed to pay $715,000 to settle a class action lawsuit alleging violations of California wage-and-hour laws, including failure to pay overtime and double-time wages at the correct rate, missed meal and rest breaks, inaccurate wage statements and other labor code violations. The settlement also covers claims for civil penalties under the California Private Attorneys General Act.

Who are the class members?

Class members must meet all of the following criteria:

  • They worked in California as a nonexempt hourly employee for Ready Pac Foods Inc., Ready Pac Produce Inc., OTS Solutions LLC or Eclipse Advantage LLC (if assigned to a Ready Pac location).
  • They worked at least one day from Sept. 8, 2022, through May 11, 2025.

There are two main groups who may benefit from this settlement:

  • Class members: Hourly employees who worked for any of the above companies at a Ready Pac location in California during the class period
  • Aggrieved employees: Hourly employees who worked at least one day during the PAGA period (also Sept. 8, 2022, through May 11, 2025) and are eligible for a PAGA payment

Who is excluded from the class?

  • OTS Solutions LLC or Eclipse Advantage LLC employees who have never been assigned to a Ready Pac location
  • Hourly employees in California who worked for Bonduelle Inc., Bonduelle USA Inc., Bonduelle US Holding Inc., Bonduelle Fresh Americas, Salad Time LLC, Missa Bay LLC or Ready Pac Florence Partnership during the relevant period

How much can class members get?

The amount each class member receives depends on how many workweeks they worked during the class period and, for PAGA payments, how many pay periods they worked during the PAGA period. The settlement divides the fund as follows:

  • Individual class payments: Based on the number of workweeks each participating class member worked
  • Individual PAGA payments: Based on the number of pay periods each aggrieved employee worked

Calculation details

  • The settlement administrator will divide the net settlement amount (after deductions for attorneys' fees, costs, administration, service awards and PAGA penalties) by the total number of workweeks all participating class members worked. Each class member's payment = (net settlement amount / total class workweeks) x their individual workweeks
  • For PAGA payments, the settlement administrator will divide the $17,875 allocated to aggrieved employees by the total number of PAGA pay periods all aggrieved employees worked. Each aggrieved employee's PAGA payment = ($17,875 / total PAGA pay periods) x their individual pay periods

No action needed to receive payment

Class members do not need to file a claim to receive a payment. Class members will automatically receive a check by mail at their last known address. Those whose address has changed should contact the settlement administrator to update it. Additionally, class members who believe the number of workweeks or pay periods attributed to them is incorrect may submit pay stubs or other records to challenge the calculation.

$715,000 settlement fund

The$715,000 settlement fund covers:.

  • Settlement administration costs: Up to $28,973
  • Attorneys' fees: Up to $250,250
  • Attorneys' expenses: Up to $35,000
  • Service awards to class representatives: Up to $10,000 each ($30,000 total)
  • PAGA penalties: $71,500 ($53,625 to the state and $17,875 to employees)
  • Payments to eligible class members: The remainder of the fund (estimated at more than $300,000)

Important dates

  • Opt-out deadline: April 20, 2026
  • Final approval hearing: July 17, 2026

When is the Ready Pac Foods wage-and-hour settlement payout date?

The settlement administrator will mail checks to eligible class members approximately 44 days after the court grants final approval to the settlement and it become final.

Why did this class action settlement happen?

The class action lawsuit alleged Ready Pac Foods Inc., Ready Pac Produce Inc. and OTS Solutions LLC violated California labor laws by failing to pay overtime and double-time wages at the correct rate, not providing required meal and rest breaks, not paying premium wages for missed breaks, issuing inaccurate wage statements, not paying all wages due at separation and other related violations.

The companies denied all wrongdoing but agreed to settle to avoid the cost and uncertainty of continued litigation.
