
Credit card holders whom Capital One wrongly reported as deceased to a credit reporting agency and who filed at least one dispute about their account(s) with Capital One between Aug. 13, 2019, and Dec. 3, 2025, and did not receive a correction may qualify to receive a cash payment from a class action settlement.
Capital One NA agreed to pay $2.4 million to settle a class action lawsuit alleging violations of the Fair Credit Reporting Act. The class action claimed Capital One failed to properly investigate disputes from credit card holders whom it incorrectly reported as deceased to credit reporting agencies.
Who is eligible for a Capital One settlement payment?
Class members must meet the following criteria:
- Capital One reported them as deceased to credit reporting agencies based on information related to their Capital One credit card account(s).
- Capital One received one or more disputes from the credit reporting agencies about their credit card account(s) between Aug. 13, 2019, and Dec. 3, 2025.
- In response to one or more of those disputes, Capital One did not correct its deceased reporting.
How much can is the class action payout?
Pro rata cash payment: Each eligible class member will receive a pro rata cash payment from the net settlement fund.
No claim form required
Class members do not need to file a claim to receive a settlement payment.
They can submit updated address information online using the notice ID and PIN from their settlement notice,or write or email the settlement administrator.

Payout options
Class members will receive a paper check mailed to the address on file with Capital One.
$2.4 million Capital One settlement fund
The $2,400,000 settlement fund will include:
- Settlement administration costs: To be determined
- Attorneys’ fees and expenses: $800,000
- Service awards to class representatives: Up to $10,000 each
- Payments to class members: Remaining settlement funds

When is the Capital One FCRA settlement payout date?
The settlement administrator will issue payments to eligible class members approximately 65 days after the court grants final approval to the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Capital One violated the Fair Credit Reporting Act by failing to properly investigate disputes from credit card holders whom it incorrectly reported as deceased to credit reporting agencies.
Capital One denies any wrongdoing but agreed to settle to avoid the risk and expense of continued litigation and a possible trial.
