California residents who received a direct mail notice from Total Vision about a data breach that occurred on Oct. 30, 2020, may qualify to submit a claim for a cash payment from a class action settlement. The cybersecurity incident impacted personal and medical information belonging to approximately 88,722 current and former patients and other individuals.

Total Vision LLC agreed to pay $475,000 to settle a class action lawsuit alleging it company failed to adequately safeguard patient and consumer information, resulting in a data security incident.

Who can file a claim for a data breach payout?

Class members are individuals who received a direct mail notice addressed to a California address regarding the October 2020 Total Vision data breach.

How much are settlement payments?

Class members can submit a claim for one or both of the following benefits:

  • Pro rata cash payment: All class members can submit a claim to receive a pro rata cash payment from the remaining net settlement fund after deductions for settlement administration costs, attorneys' fees and costs, and service awards to class representatives. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • Reimbursement of documented out-of-pocket expenses: Class members can claim up to $1,000 for documented expenses that are fairly traceable to the data breach. Eligible expenses include monetary losses due to identity theft, card replacement fees and credit monitoring purchased after Feb. 28, 2022.

To claim a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

When is the Total Vision data breach settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.

Why is there a class action settlement?

This class action lawsuit alleged Total Vision LLC failed to adequately safeguard personal and medical information, resulting in a data breach on Oct. 30, 2020. The plaintiffs claimed violations of California’s Confidentiality of Medical Information Act, negligence, breach of implied contract and other state laws.

Total Vision denies the allegations but agreed to settle to avoid the expense and uncertainty of continued litigation. The settlement also requires the company to implement additional data security measures for at least two years (valued at more than $224,000 annually).
