
U.S. residents whose personal information a data incident involving Therapeutic Health Services potentially compromised in on or around Feb. 26, 2024, may be eligible to claim up to $5,000 from a class action settlement.
Therapeutic Health Services agreed to pay $790,000 to resolve a class action lawsuit alleging it failed to adequately protect the personal information of current and former patients and employees during a cybersecurity incident.
Who is eligible to file a claim?
Class members must meet all of the following criteria:
- They are residents of the United States.
- Threat actors accessed or acquired their personal information during the data incident involving THS that occurred on or around Feb. 26, 2024.
- THS' records identified them as a class member.
The class includes both current and former patients and employees.
How much can class members receive?
Class members can receive one or more of the following:
- Reimbursement for out-of-pocket losses: Up to $5,000 for documented losses that are fairly traceable to the data incident and have not been reimbursed from another source. Eligible losses include:
- Unreimbursed losses from fraud or identity theft
- Professional fees, such as those for attorneys, accountants or credit repair services
- Costs to freeze or unfreeze credit with any credit reporting agency after Feb. 26, 2024
- Credit monitoring costs incurred on or after Feb. 26, 2024, through the date of claim submission
- Miscellaneous expenses, such as notary, fax, postage, copying and mileage
- Cash payment: Up to $100. The settlement administrator may reduce the final amount on a pro rata basis depending on the number of valid claims and available funds.
- Credit monitoring services: Three years of three-bureau credit monitoring for class members who submit a valid claim.
How to claim a settlement payout
Class members can file a claim online or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is Jan. 13, 2026.

What is required to submit a claim?
- To claim out-of-pocket losses, class members must provide documentation, such as receipts, statements or other proof of loss plus a description and certification that no one else reimbursed the loss. Self-prepared documents, like handwritten receipts, are not sufficient on their own but class members may submit them to to clarify or support other documentation.
- No documentation is required to claim a cash payment or credit monitoring.

$790,000 settlement fund breakdown
The $790,000 settlement fund covers:
- Settlement administration costs: To be determined
- Attorneys’ fees: Up to $237,000
- Attorneys’ expenses: Up to $25,000
- Service awards to class representatives: Up to $4,000 each to four representatives (Up to $16,000 total)
- Payments to class members: Remainder of the fund

When is the THS data breach settlement payout date?
The settlement administrator will distribute payments after it resolves any appeals and the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged a data incident allowed unauthorized parties to access Therapeutic Health Services' personal information. The plaintiffs claimed THS is responsible for the incident.
THS denies all allegations and any wrongdoing. Both sides agreed to settle to avoid the costs and risks of litigation and to provide compensation to class members.
