
Individuals who you received more than one telephone solicitation call from Sirius XM between April 27, 2019, and Oct. 31, 2025, and were not a self-paying subscriber or asked Sirius XM not to call them may be eligible to claim a cash payment from a class action settlement.
Sirius XM Radio LLC agreed to pay $28,000,000 to settle a class action lawsuit alleging Sirius XM made telephone calls to individuals registered on the National Do Not Call Registry or on Sirius XM’s own internal do not call registry in violation of federal and state telemarketing laws.
Who can file a claim?
Class members must meet one of the following criteria:
- They are a natural person in the United States.
- They received more than one telephone solicitation call in a 12-month period between April 27, 2019, and Oct. 31, 2025, on their landline, wireless, cell or mobile telephone number by or on behalf of Sirius XM.
- They received the call more than 31 days after registering their number with the National Do Not Call Registry.
- They were not a self-paying Sirius XM subscriber at the time of the first call or before the start of the second call OR
- They asked to register that number on Sirius XM’s internal do not call list.
If more than one person in a household qualifies, each person may file a separate claim.
How much can class members get?
The total settlement fund is $28,000,000. After deducting administrative costs, attorneys’ fees and expenses, and service awards for the named plaintiffs, the settlement administrator will distribute the remaining funds to eligible class members who submit valid claims.
How to claim a settlement payment
Class members can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. The claim deadline is March 21, 2026.

$28 million settlement fund breakdown
The settlement fund of $28,000,000 covers:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $9,333,333.33
- Attorneys' expenses: Up to $300,000
- Service awards to class representatives: To be determined
- Payments to eligible class members: Remaining funds
The fund is non-reversionary, meaning the settlement administrator will redistribute any unclaimed amounts to valid claimants or as directed by the court.

When is the Sirius XM TCPA settlement payout date?
The settlement administrator will issue payments to eligible class members approximately 30 days after the court resolves any appeals and grants final approval of the settlement.
Why did Sirius XM agree to a class action settlement?
The class action lawsuit alleged Sirius XM made unsolicited telephone calls to individuals who registered their numbers on the National Do Not Call Registry or Sirius XM’s internal do not call registry. The plaintiffs claimed these calls violated the Telephone Consumer Protection Act and similar state and federal laws.
Sirius XM denies any wrongdoing but agreed to settle to avoid the uncertainty and expense of continued litigation. In addition to monetary relief, the company will implement additional business practices to improve compliance with telemarketing laws, including enhanced consumer notifications and regular review of telemarketing vendor practices.
