Individuals who received a notice from HopSkipDrive or an affiliated entity that their personal information may have been compromised in a data breach between May 31, 2023, and June 10, 2023, may qualify to submit a claim for up to $5,000 and credit monitoring from a class action settlement.

HopSkipDrive Inc. has agreed to pay $1.99 million to settle a class action lawsuit for allegedly failing to adequately protect the private information of individuals affected by a cybersecurity incident. The data breach compromised names, addresses, dates of birth, driver's license numbers, Social Security numbers and medical information belonging to an estimated 155,000 users.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • Their private information may have been involved in the data breach that occurred between May 31, 2023, and June 10, 2023.
  • They received a notice from HopSkipDrive or an affiliated entity about the incident on or around Nov. 14, 2023.

How much is the settlement payment?

Class members can submit to receive one or more of these benefits:

  • Expanded identity theft and fraud monitoring: All class members can elect to receive two years of three-bureau credit monitoring, up to $1 million in identity theft insurance. Class members that already have identity theft monitoring may still submit to receive this benefit.
  • Documented out-of-pocket loss payment: Class members can claim up to $5,000 for unreimbursed losses traceable to the data breach. This includes monetary losses due to fraud, phone or internet charges, credit freeze costs, or credit monitoring purchased after May 31, 2023.
  • Reimbursement for lost time: Class members can claim up to five hours for lost time spent dealing with the data breach, at $25 per hour, a maximum $125.
  • Additional cash payment: All class members can submit to receive a pro rata cash payment, estimated at $100. Final payment amount will be determined by the total number of claims filed.
  • California statutory cash payment: Class members who were California residents at any time between May 31, 2023, and April 14, 2026 can submit to receive an additional pro rata cash payment, estimated at $250. Final payment amount will be determined by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

  • Notice ID and Confirmation Code from settlement notice required to submit a claim.
  • Out-of-pocket loss claims require supporting documentation which may include receipts, bank or credit card statements showing unreimbursed fees or losses due to fraud, or other proof of identity theft or fraud.

$1.99 million data breach settlement fund

The settlement fund of $1,985,000 will include:

  • Settlement administration costs: Estimated at $172,731
  • Attorneys' fees: Up to $694,750
  • Attorneys' cost and expenses: To be presented to the court for approval at a later date
  • Service awards to class representatives: Up to $2,500 each
  • Expanded identity theft and fraud monitoring services: Cost determined by number of claims filed
  • Payments to approved claimants: Remaining settlement funds

When is the HopSkipDrive data breach settlement payout date?

Payments and identity theft monitoring information will be issued to approved claimants approximately 90 days after the court grants final approval of the settlement, or after claim processing is completed, whichever is later.

Why did this class action settlement happen?

The class action lawsuit alleged that HopSkipDrive Inc. failed to adequately protect the private information of its users, resulting in a data breach where sensitive personal information was compromised.

The company denies the allegations, but both parties agreed to settle to avoid the uncertainty and expense of continued litigation.
