Individuals who received a notice from HopSkipDrive or an affiliated entity stating a data breach that occurred between May 31, 2023, and June 10, 2023, may have compromised their personal information could qualify to submit a claim for up to $5,000 plus other benefits from a class action settlement.

HopSkipDrive Inc. agreed to pay $1.99 million to settle a class action lawsuit alleging it failed to adequately protect the private information of individuals affected by a cybersecurity incident. The data breach compromised names, addresses, dates of birth, driver's license numbers, Social Security numbers and medical information belonging to an estimated 155,000 users.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • Their private information may have been involved in the data breach that occurred between May 31, 2023, and June 10, 2023.
  • They received a notice from HopSkipDrive or an affiliated entity about the incident on or around Nov. 14, 2023.

How much is the settlement payment?

Class members can submit a claim to receive one or more of these benefits:

  • Documented out-of-pocket loss payment: Class members can submit a claim to receive up to $5,000 for unreimbursed losses traceable to the data breach. This includes monetary losses due to fraud, phone or internet charges, credit freeze costs or credit monitoring purchased after May 31, 2023.
  • Reimbursement for lost time: Class members can submit a claim to receive up to five hours of lost time spent dealing with the data breach at $25 per hour for a maximum $125.
  • Additional cash payment: All class members can submit a claim to receive a pro rata cash payment estimated at $100. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • California statutory cash payment: Class members who were California residents at any time between May 31, 2023, and April 14, 2026 can submit a claim to receive an additional pro rata cash payment estimated at $250. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • Expanded identity theft and fraud monitoring: All class members can elect to receive two years of three-bureau credit monitoring with up to $1 million in identity theft insurance. Class members who already have identity theft monitoring may still submit a claim to receive this benefit.

How to claim a class action rebate

Class members can file a claim online or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline April 14, 2026.

  • All class members must provide the notice ID from the personalized notice they received in the mail or via email.
  • Out-of-pocket loss claims require supporting documentation, which may include receipts, bank or credit card statements showing unreimbursed fees or losses due to fraud or other proof of identity theft or fraud.

When is the HopSkipDrive data breach settlement payout date?

The settlement administrator will issue payments and identity theft monitoring information to approved claimants approximately 90 days after it completes claim processing or the court grants final approval of the settlement, whichever is later.

The class action lawsuit alleged HopSkipDrive Inc. failed to adequately protect the private information of its users, resulting in a data breach.
