Individuals who received a notice stating the May 2024 Thompson Coburn data breach compromised their personal information may be eligible to claim up to $5,000 and/or credit monitoring from a class action settlement.

Thompson Coburn LLP agreed to pay $7,500,000 to resolve a class action lawsuit claiming a targeted cyberattack exposed sensitive personal data.

Who can file a claim?

To be eligible for compensation, class members must meet the following criteria:

  • They received a notice informing them the May 2024 Thompson Coburn LLP data incident affected their private information.
  • Their name appears on the class list Thompson Coburn compiled.

How much can class members get?

Class members may claim one of two types of cash payments:

  • Cash payment A – documented losses: Reimbursement of up to $5,000 for documented, unreimbursed out-of-pocket losses related to the data incident. Eligible expenses include:
    • Losses due to identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit
    • Costs to replace IDs
    • Postage for contacting banks by mail
  • Cash payment B – pro rata cash payment: A one-time cash payment estimated at $150 for all class members who file a valid claim. The actual amount may be higher or lower depending on the number of claims and deductions for attorneys’ fees and costs, service awards and settlement administration costs. No documentation is required for this option.

In addition, all class members may claim three years of medical data monitoring from CyEx Medical Shield Total. This includes medical identity theft insurance and monitoring services.

How to claim settlement benefits

Class members can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. The claim deadline is July 23, 2026.

The settlement administrator already mailed enrollment codes for medical credit monitoring to class members. They can activate them after final settlement approval.

What proof or documentation is required to submit a claim?

  • For cash payment A – documented losses, class members must provide third-party documentation (such as receipts, bank statements or official correspondence) showing the expenses or losses and their relation to the data incident. Class members may include self-prepared notes if they supplement the claim, but they are not valid on their own. Only unreimbursed losses are eligible. The settlement administrator may reduce claims if the total amount claimed exceeds the available funds.
  • For cash payment B – pro rata cash payment, no documentation is required.

When is the Thompson Coburn data breach settlement payout date?

The settlement administrator will issue payments no later than 60 days after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Thompson Coburn LLP failed to adequately protect sensitive personal information during a targeted cyberattack in May 2024. The plaintiffs claimed an unauthorized party accessed files containing names, dates of birth, health information, Social Security numbers and other data.

Thompson Coburn denies any wrongdoing but agreed to settle the lawsuit to avoid the costs and risks of continued litigation.
