
California-based truck drivers who worked for CRST Expedited Inc. and whom the company paid by piece rate between Aug. 9, 2017, and April 10, 2023, may be eligible to receive a payment from a class action settlement.
CRST Expedited Inc. agreed to pay $14.5 million to resolve a class action lawsuit alleging it violated California wage-and-hour laws, including failure to pay minimum wage for non-driving time, failure to pay all owed wages, failure to reimburse business expenses and other related claims. The settlement also addresses claims brought under the California Private Attorneys General Act.
Who are the class members?
Class members must meet all of the following criteria:
- They had a residential address in California.
- They worked as a truck driver for CRST Expedited Inc.
- CRST Expedited compensated them by piece rate at any time from Aug. 9, 2017, through April 10, 2023.
- They did not participate in the settlement of Montoya v. CRST Expedited Inc., Case No. 16-cv-10095-PBS (D. Mass.).
There are two main groups included in the settlement:
- Class members: All current and former California-resident truck drivers CRST Expedited paid by piece rate between Aug. 9, 2017, and April 10, 2023, excluding those who participated in the Montoya settlement.
- PAGA group members: All current and former California-resident truck drivers CRST Expedited paid by piece rate between Aug. 9, 2020, and April 10, 2023, excluding those who participated in the Montoya settlement.
Some individuals may qualify for both groups.
How much are settlement payouts?
The total settlement fund is $14,500,000. The amount each class member receives depends on the number of weeks they worked during the class period and, if eligible, the number of pay periods they worked during the PAGA period. There are two main parts to the settlement:
- Class settlement: The settlement administrator will divide the net settlement fund (after deductions for attorneys' fees and costs, service awards, administration costs and PAGA penalties) among participating class members based on the number of weeks they worked for CRST in California during the class period.
- PAGA settlement: The PAGA portion of the settlement allocates $181,250 for the settlement administrator to divide among PAGA class members based on the number of pay periods they worked during the PAGA period.
No claim form required
Class members do not need to submit a claim form to receive their payment. The settlement administrator will automatically mail checks to eligible class members and PAGA group members using the last known address on file. Those whose address has changed should update their information with the settlement administrator to ensure they receive payment.
Those who wish to dispute their calculated workweeks or pay periods must contact the administrator and provide documentation to support their claim.

Payout options
The settlement administrator will mail checks to the address on file. Class members must cash checks within 180 days of issuance.
$14.5 million settlement fund breakdown
The settlement fund of $14,500,000 will cover:
- Settlement administration costs: Up to $65,363
- Attorneys' fees: Up to $4,833,333.33
- Attorneys' expenses: Up to $410,000
- Service award to class representative: Up to $15,000
- PAGA penalties: $725,000 (75% to the state and 25% to PAGA group members)
- Payments to eligible class members: The remainder of the fund (estimated at $8,486,303.67)

When is the Huckaby v. CRST Expedited Inc. payout date?
The settlement administrator will mail payments to approved claimants within 15 days after the court resolves any appeals and grants final approval of the settlement.
Why did this class action settlement happen?
The lawsuit alleged CRST Expedited Inc. failed to pay California truck drivers minimum wages for non-driving time, did not pay all owed wages, failed to reimburse business expenses and did not provide accurate wage statements or timely pay wages.
CRST denied any wrongdoing but agreed to settle the lawsuits to avoid the risks and expenses of continued litigation.
