Employees who worked as an instructional assistant for Tailored Living Choices in California between June 29, 2017, and May 15, 2025, may qualify to claim a cash award from a class action settlement.

Tailored Living Choices LLC agreed to pay $580,000 to settle a class action lawsuit alleging violations of California and federal labor laws. The lawsuit included claims of unpaid wages and overtime, unreimbursed business expenses and related labor violations.

Who are the class members?

  • Fair Labor Standards Act collective members: Anyone who worked as an instructional assistant for Tailored Living Choices at any time between Dec. 1, 2020, and May 15, 2025
  • Private Attorneys General Act Employees: Anyone who worked as an instructional assistant for Tailored Living Choices at any time between Oct. 29, 2020, and May 15, 2025
  • California class members: Anyone who worked as an instructional assistant in California for Tailored Living Choices at any time between June 29, 2017, and May 15, 2025
  • Waiting time penalties subclass: Individuals in the California class who separated from employment between June 29, 2018, and May 15, 2025

Each group is eligible for different types of payments, and class members may be part of more than one group. The settlement administrator identified class members using employment records and sent notices to those believed to be eligible.

How much can class members get?

The total settlement fund is $580,000. After deductions for attorneys' fees, costs, service awards and administration expenses, the settlement administrator will distribute approximately $266,666.66 to eligible class members. The amount each person receives depends on which group(s) they belong to and how many weeks they worked as an instructional assistant during the relevant periods compared to others in the same group.

The net settlement fund is divided as follows:

  • California class members: 40% of the net settlement fund (about $106,666.67) distributed pro rata based on the number of weeks worked during the class period
  • Waiting time penalties subclass: 30% of the net settlement fund (about $80,000) divided equally among subclass members who separated from employment during the relevant period
  • Fair Labor Standards Act collective members: 30% of the net settlement fund (about $80,000) distributed pro rata based on the number of weeks worked during the FLSA period
  • Private Attorneys General Act employees: $20,000 total with 25% ($5,000) distributed among PAGA employees based on weeks worked and 75% ($15,000) paid to the California Labor and Workforce Development Agency

Class members who qualify for more than one group will receive a share from each. The actual amount class members receive may increase or decrease depending on the number of people who opt out of the settlement.

How to claim a class action payment

For the California class or Private Attorneys General Act payments, no action is needed to receive payment. Class members will automatically receive a check if the settlement is approved.

To claim the Fair Labor Standards Act collective payment, class members can submit the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. Alternatively, they can simply cash the FLSA collective settlement check when they receive it, which will be considered opting in.

To file an online claim, class members must provide their CPT ID and passcode located on the notice they received. Those who do not have a CPT ID and/or passcode should email tailoredlivingsettlement@cptgroup.com.

Class members who believe their workweeks are incorrect may submit supporting documentation (such as paystubs) to dispute the calculation.

Payout options

The settlement administrator will mail checks to eligible class members at their last known address or the address provided on the claim form.

The $580,000 settlement fund covers:

  • Settlement administration costs: $35,000
  • Attorneys' fees: $193,333.34
  • Attorneys' costs: $35,000
  • Service awards to class representatives: $10,000 each ($30,000 total)
  • PAGA payment: $20,000 ($15,000 to the state and $5,000 to employees)
  • Payments to eligible class members: Approximately $266,666.66

When is the Basham v. Tailored Living Choices LLC payout date?

The settlement administrator will mail payments to eligible class members within 49 days of final court approval and the expiration of any appeal period. Checks must be cashed within 180 days of mailing.

Why did this class action settlement happen?

The class action lawsuit alleged Tailored Living Choices failed to pay minimum and overtime wages, did not pay for all hours worked (including travel and sleep time), used an unlawful rounding policy and failed to reimburse business expenses.

The company denied all wrongdoing but agreed to settle to avoid the risks and costs of continued litigation.
