Those who worked as nonexempt, hourly employees for Robertson’s Transport Ltd. in California between Nov. 5, 2021, and July 30, 2025, may be eligible to receive a cash payment from a class action settlement.

Robertson’s Transport Ltd. agreed to pay $1.4 million to resolve a class action lawsuit alleging violations of California wage-and-hour laws, including claims of unpaid overtime, missed meal and rest breaks, failure to provide accurate wage statements and other employment-related violations. The settlement also includes penalties under the California Private Attorneys General Act.

Who are the class members?

The settlement covers two main groups:

  • Class members: Anyone whom Robertson’s Transport Ltd. employed (directly or through a subsidiary, staffing agency, joint venture or professional employer organization) as a nonexempt, hourly paid employee in California during the class period, which is Nov. 5, 2021, to July 30, 2025
  • Aggrieved employees: All nonexempt, hourly paid employees who worked for Robertson’s Transport Ltd. during the PAGA period, which is Aug. 14, 2022, to July 30, 2025

How much can class members get?

The total settlement fund is $1,400,000. The amount each person receives depends on the number of workweeks or pay periods they worked and the total number of eligible participants.

  • Individual class payments: The settlement administrator will distribute individual class payments to all participating class members based on the number of weeks they worked during the class period. It will divide the net settlement amount (after deductions) by the total number of weeks all participating class members worked, and each member will receive a share proportional to their own workweeks.
  • Individual PAGA payments: The settlement administrator will distribute individual PAGA payments to aggrieved employees based on the number of pay periods they worked during the PAGA period. Of the $50,000 set aside for PAGA penalties, the settlement allocates 25% ($12,500) for direct payments to aggrieved employees with the remaining 75% ($37,500) to the California Labor and Workforce Development Agency.

The settlement administrator considers 33% of each individual class payment as wages subject to tax withholdings (reported on IRS W-2). It considers the remaining 67% as interest and penalties (reported on IRS 1099). The administrator considers PAGA payments as penalties (reported on IRS 1099).

No action needed to receive payment

Eligible class members and aggrieved employees do not need to file a claim to receive payment. The settlement administrator will automatically mail checks to the address on file for each eligible participant.

Class members can challenge their payment calculation if they believe the records underestimate their workweeks or pay periods by providing a written challenge with supporting documentation by July 24, 2026.

Payout options

The settlement administrator will mail checks via U.S. mail to the address on file unless the class member updates it. If a class member loses or misplaces the check, they may request a replacement from the settlement administrator. The administrator will donate checks that remain uncashed after the void date to the California controller’s unclaimed property fund.

$1.4 million settlement fund breakdown

The $1,400,000 settlement fund includes:

  • Settlement administration costs: Up to $10,900
  • Attorneys’ fees: Up to $466,666.67
  • Attorneys’ expenses: Up to $30,000
  • Service awards to class representatives: Up to $10,000 each ($20,000 total)
  • PAGA penalties: $50,000 ($37,500 to the California Labor and Workforce Development Agency and $12,500 to aggrieved employees)
  • Payments to eligible class members: The remainder of the fund

When is the Robertson’s Transport settlement payout date?

The settlement administrator will mail payments approximately 45 days after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Robertson’s Transport Ltd. violated California labor laws by failing to pay overtime and minimum wages, not providing meal and rest breaks, failing to pay sick pay and wages upon termination, not reimbursing expenses and issuing inaccurate wage statements. The case also included claims for civil penalties under the California Private Attorneys General Act.

Robertson’s Transport Ltd. denied all allegations but agreed to settle to avoid the expense and uncertainty of further litigation.
