Current and former patients in the United States who received a notice that their personal information may have been exposed in the February 2024 Rebound Orthopedics & Neurosurgery data breach, may qualify to submit a claim for up to $5,000 and other benefits from a class action settlement.

Rebound Orthopedics & Neurosurgery P.C. has agreed to pay $2.5 million to settle a class action lawsuit that arose after a cyberattack on its computer systems in February 2024. The lawsuit alleges that files containing sensitive personal and protected health information, including names, dates of birth, Social Security numbers, driver’s license numbers, medical information, health insurance details and financial account information, may have been accessed during the incident.

Who can file a data breach claim?

Class members are individuals residing in the United States who had their PII and PHI potentially accessed in the February 2024 data breach, including those who were sent notice by Rebound Orthopedics & Neurosurgery.

How much is the settlement payout

Class members have the following benefit options:

  • Credit and medical data monitoring: All class members can elect to receive two years of CyEx Medical Shield Complete, which includes credit and medical monitoring, real-time alerts, $1 million in identity theft insurance and fraud resolution assistance.
  • Documented losses - Cash payment A: Class members can claim up to $5,000 in documented out-of-pocket losses traceable to the data breach that occurred between Feb. 1, 2024, and May 28, 2026. This includes monetary losses due to identity theft or fraud, fees for freezing/unfreezing credit, credit reports, credit monitoring services purchased after the breach, cost to replace government issued IDs and postage for correspondence with banks and credit card companies.
  • Alternate cash payment - Cash payment B: Class members that do not submit a documented losses claim can submit to receive an a pro rata alternate cash payment, estimated at $75. Final payment amount will be determined by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to fill out and mail to the settlement administrator/

Claims must be submitted online or postmarked by May 28, 2026.

Is proof/documentation required to submit a claim?

  • Unique ID and PIN from settlement notice required to submit a claim online.
  • Documented losses claims require proof, which may include receipts or other documentation showing the expense or monetary loss was due to the data breach.

Payout options

  • Electronic payment, available only for claims submitted online
  • Paper check mailed to the address provided

$2.5 million data breach settlement fund

The $2,500,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $833,333
  • Attorneys' expenses: To be presented to the court for approval at a later date
  • Service awards to class representatives: $2,000 each, $18,000 total
  • Credit and medical monitoring: Cost determined by number of claims filed
  • Payments to approved claimants: Remaining settlement funds

When is the Rebound Orthopedics & Neurosurgery settlement payout date?

Payments and credit monitoring information will be distributed approximately 60 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit was filed after a cyberattack on Rebound Orthopedics & Neurosurgery’s computer systems in February 2024. Plaintiffs alleged that the company failed to adequately protect sensitive personal and medical information, which may have been accessed by unauthorized parties.

Rebound denies the allegations but agreed to settle to avoid the expense and uncertainties of continued litigation.
