Consumers who purchased Poppi beverages for household use in the United States between Jan. 23, 2020, and July 18, 2025, may qualify to claim a cash payment from a class action settlement.

VNGR Beverage LLC, doing business as Poppi, agreed to pay $8.9 million to settle a class action lawsuit alleging it misrepresented its beverages as “gut healthy” through its labeling and marketing.

Who can file a Poppi claim?

The settlement class includes all individuals in the United States who purchased any flavor or package size of Poppi beverages for household use (not for resale or distribution) between Jan. 23, 2020, and July 18, 2025.

The settlement defines a “household” as any number of people occupying the same dwelling unit. Multiple people living together are considered a single household for the purposes of this settlement. If more than one claim is submitted from the same household, those claims will be treated as a single claim.

How much can class members get?

The amount class members can receive depends on the quantity and type of Poppi beverages they purchased and whether they can provide proof of purchase.

  • Class members can submit a claim with proof of purchase can receive:
    • $0.75 per single can (12-ounce or 16-ounce)
    • $3 per four-pack
    • $6 per eight-pack
    • $9 per 12-pack or 15-pack
  • Class members who do not provide proof of purchase can claim a maximum of $16 per household per the above regardless of the number of products purchased.
  • The minimum payment for any approved claim is $5 per household.

Pro rata adjustments

If the total calculated amount based on proof of purchase exceeds $16, the higher amount will be paid subject to available funds and potential pro rata adjustments. The actual payment may be reduced or increased depending on the total number of approved claims and the costs deducted from the settlement fund, such as administrative expenses, attorneys’ fees and service awards to the class representatives. If there are leftover funds after all payments and expenses, the remainder will be donated to a charitable organization.

How to claim a class action payment

Class members can submit an online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. Claims must be submitted online or postmarked by Sept. 26, 2025

Is proof required to submit a claim?

Proof of purchase is required for class members who want to claim more than $16 per household. Acceptable proof includes receipts or other documentation from a third-party commercial source (such as a store or online retailer) that shows the purchase of Poppi beverages between Jan. 23, 2020, and July 18, 2025.

$8.9 million settlement fund breakdown

The $8,900,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $2,670,000
  • Attorneys’ expenses: Up to $35,000
  • Service awards to class representatives: $5,000 each ($15,000 total)
  • Payments to eligible class members: Remainder of the fund

Important dates

  • Deadline to file a claim: Sept. 26, 2025
  • Deadline to opt out: Sept. 26, 2025
  • Final approval hearing: Nov. 20, 2025

When is the Poppi settlement payout date?

If the court approves the settlement at the final approval hearing and there are no appeals, payments will be distributed within 90 days after the settlement becomes final. If there are appeals, the process may take longer.

Why was there a class action settlement?

The class action lawsuits alleged VNGR Beverage LLC, doing business as Poppi, misrepresented its beverages as “gut healthy” through labeling and marketing. The plaintiffs claimed consumers paid more or purchased products they otherwise would not have bought due to these representations.

The company denies any wrongdoing or liability, asserting its labeling is truthful and accurate. Both sides agreed to settle to avoid the risks and costs of continued litigation.
