New York School of Interior Design Data Breach Settlement

Individuals who received notice that the November 2023 data breach at the New York School of Interior Design compromised their personal information may be eligible to claim up to $5,500 and credit monitoring from a class action settlement.

New York School of Interior Design agreed to settle a class action lawsuit claiming a targeted cyberattack occurred in November 2023. The lawsuit alleged the breach exposed sensitive personal information, including Social Security numbers, driver’s license and passport numbers, financial account details, payment card data, health insurance and medical information, taxpayer identification numbers, student identification numbers and biometric data.

Who can file a claim?

Class members are all individuals residing in the United States whose personally identifiable information the November 2023 NYSID data incident impacted. This includes everyone who received notice of the data breach from NYSID.

How much can class members get?

Class members have the following options:

  • Extraordinary losses: Class members can claim up to $5,000 for documented losses due to identity theft or fraud that are directly linked to the breach and that other reimbursements do not already cover.
  • Ordinary losses: Class members can claim up to $500 for documented out-of-pocket expenses related to the data breach, such as credit monitoring fees, costs to replace IDs or postage to contact banks.
    • Lost time: Class members can claim up to four hours at $25 per hour (maximum $100) for time spent addressing the breach, such as changing passwords or investigating suspicious activity. This amount counts toward the $500 cap for ordinary losses.
  • Alternative cash payment: Class members who do not wish to claim reimbursement for losses or lost time can receive a one-time $50 payment.
  • Credit monitoring services: All class members can enroll in three years of three-bureau credit monitoring, which includes $1 million in financial fraud insurance and monitoring for identity theft, unauthorized transactions and high-risk activity.

The class action lawsuit claimed a targeted cyberattack affected NYSID’s computer systems in November 2023. The lawsuit alleged the breach impacted private information, putting class members at risk of identity theft and financial loss.

NYSID denied any wrongdoing but agreed to settle to avoid the expense and uncertainty of further litigation.
