Individuals who received notice from Premium Mortgage Corp. indicating a data breach may have exposed their personal information could be eligible to claim up to $5,425 and/or credit monitoring from a class action settlement.

Premium Mortgage Corp. agreed to resolve a class action lawsuit alleging it failed to protect customer data, resulting in unauthorized access to sensitive information.

Who can file a claim?

Individuals must meet all of the following criteria:

  • The data incident involving Premium Mortgage Corp. systems between Aug. 24, 2023, and Aug. 31, 2023, potentially compromised their personally identifiable information.
  • They received a notice from Premium Mortgage Corp. on or around Jan. 10, 2024, informing them of the breach.

How much can class members receive?

The settlement provides several types of compensation:

  • Documented ordinary out-of-pocket losses: Up to $325 for unreimbursed expenses directly associated with the data incident. Examples include bank fees, postage, gas for local travel, credit repair fees, costs to freeze or unfreeze credit and credit monitoring service costs. The class member must have incurred these expenses between Aug. 23, 2023, and April 21, 2026 (for credit monitoring service costs, between Jan. 10, 2024, and April 21, 2026).
  • Documented extraordinary losses: Up to $5,000 for actual, documented and unreimbursed monetary losses from identity theft or fraud the data incident caused. To qualify, the ordinary out-of-pocket category cannot cover the loss, which must have occurred between Aug. 23, 2023, and April 21, 2026. Class members must show they made reasonable efforts to recover the loss elsewhere (such as through insurance).
  • Lost Time: Up to four hours at $25 per hour ($100 maximum) for time spent dealing with the data incident. Class members must briefly describe how they spent the time.
  • Alternative cash payment: A one-time payment of $50 for class members who do not claim any of the above monetary benefits.
  • Credit monitoring: Three years of one-bureau credit monitoring and identity theft protection services, including at least $1 million in identity theft insurance. This benefit is available to all class members regardless of whether they claim monetary compensation.

How to claim a class action payout

Class members can file the online claim form or download and print the PDF claim form, complete it and mail it to the settlement administrator. They can also request a claim form by calling 1-877-269-4189 or emailing Info@PMCDataLitigation.com.

What proof or documentation is necessary to submit a claim?

  • All claimants must provide the notice ID from their settlement notice to file a claim. Online claimants must also provide the confirmation code from the same notice.
  • To file an ordinary out-of-pocket loss claim, class members must submit receipts, bank statements or other documentation showing the expense and that it was not reimbursed.
  • To file an extraordinary out-of-pocket loss claim, class members must provide proof of monetary loss from identity theft or fraud along with evidence of reasonable efforts to recover the loss elsewhere (such as insurance claim denials).
  • To file a lost time claim, class members must provide a brief description of how they spent the time.
  • To file an alternative cash payment or credit monitoring claim, class members need only select the appropriate option on the claim form.

Settlement fund breakdown

When is the Premium Mortgage Corp. settlement payout date?

The settlement administrator will issue payments and credit monitoring activation codes approximately 30 days after it approves the claim or 60 days after the court resolves any appeals and grants final approval to the settlement, whichever is later.

Why did this class action settlement happen?

The class action lawsuit alleged a a data incident in January 2024 at Premium Mortgage Corp. potentially allowed unauthorized access to customer information in August 2023. The plaintiffs claimed the company failed to adequately protect personal information, resulting in exposure of sensitive data such as names, Social Security numbers, payment card information and financial account details.

Premium Mortgage Corp. denies any wrongdoing but agreed to settle to avoid the risks, costs and uncertainty of further litigation.
