Individuals who received a written notification from Kittles Home Furnishings Inc. informing them a data breach that occurred between Feb. 7, 2023, and Feb. 17, 2023, accessed their personal information may be eligible to claim up to $5,590 from a class action settlement.

Kittles Home Furnishings Inc. agreed to settle a class action lawsuit alleging negligence, breach of implied contract, unjust enrichment and bailment related to a data breach that compromised employee personal information.

Who can file a claim?

Individuals are eligible to file a claim if:

  • They are the named plaintiff in the lawsuit OR
  • They received a formal written notification from Kittles Home Furnishings Inc. stating the data breach that occurred between Feb. 7, 2023, and Feb. 17, 2023, compromised their personal information.

Only those who are on the official class list, meaning those who received direct written notice from Kittles about the breach, are eligible to receive settlement benefits. Those who did not receive such notification are not eligible to participate in the settlement.

How much can class members get?

Class members who submit a valid claim may be eligible for the following types of compensation:

  • Out-of-pocket losses: Up to $500 for ordinary expenses, including professional fees (such as attorneys’ or accountants’ fees); costs for credit repair services, credit monitoring, or freezing or unfreezing credit; and miscellaneous expenses like notary, fax, postage, copying and mileage. These expenses must be directly related to the breach and incurred between the breach date and seven days after the administrator sent notice to the class.
  • Extraordinary expenses: Up to $5,000 for actual, documented and unreimbursed monetary losses caused by misuse of personal information or identity theft linked to the breach. The loss must be related to the breach, have occurred within the specified timeframe and not already be covered by other categories. Claimants must have made reasonable efforts to avoid or seek reimbursement for the loss, including exhausting any credit monitoring or identity theft insurance.
  • Lost time: Up to $90 for time spent addressing the effects or potential effects of the data breach at $22.50 per hour for up to four hours. Claimants must provide a description of the activities performed and attest to the time spent.
  • Alternative cash payment: A $50 payment available to class members who do not claim out-of-pocket losses or lost time. No documentation is required for this option.

How to claim a settlement payment

Class members can submit the online claim form or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline is May 18, 2026.

Claimants should ensure all information is accurate and notify the settlement administrator if their contact information changes after submitting the claim.

What proof or documentation is required to submit a claim?

  • All claimants must provide the claimant ID from the settlement notice they received.
  • To claim out-of-pocket losses (ordinary or extraordinary), claimants must provide third-party documentation, such as receipts or bills. Self-prepared documents like handwritten receipts are not sufficient on their own, but the class member may use them to clarify other documentation.
  • To claim lost time, claimants must provide a written description of the actions they took and time they spent.
  • To claim the alternative cash payment, claimants need to select the appropriate option on the claim form.

When is the Ballard v. Kittles Home Furnishings Inc. payout date?

The settlement administrator will issue payments approximately 20 days after it approves claims or 30 days after the court resolves any appeals and grants final approval to the settlement, whichever is later.
