
Individuals who received a notice stating the January 2024 Omni Healthcare data breach may have affected their private information could be eligible to claim up to $5,000 and medical data monitoring from a class action settlement.
Omni Healthcare Financial Holdings, along with Omni Healthcare Financial LLC and Injury Finance LLC, agreed to settle a class action lawsuit alleging a cyberattack in January 2024 allowed an unauthorized party to access files on Omni Healthcare’s network. These files may have included personal and medical information, such as names, dates of birth, medical record numbers, treatment details and, in some cases, Social Security numbers, health insurance or financial account information.
Who can file a claim?
The class includes all individuals in the United States whose private information the January 2024 Omni Healthcare data incident impacted, including those who received a notice regarding the breach.
How much can class members receive?
- Cash payment A – documented out-of-pocket losses: Class members who incurred actual, documented out-of-pocket losses as a result of the data breach can claim reimbursement for up to $5,000. The losses must have occurred between Jan. 18, 2024, and Sept. 3, 2026. Covered expenses include:
- Losses due to identity theft or fraud
- Fees for credit reports, credit monitoring or freezing/unfreezing credit
- Costs to replace IDs
- Postage for contacting banks by mail
- Cash payment B – alternate cash: Class members who do not wish to or cannot claim documented losses may instead elect to receive a one-time cash payment of $40. This option does not require documentation.
- Medical data monitoring: All class members are eligible to enroll in three years of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance and monitoring for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending. If the program detects suspicious behavior, class members may speak to a fraud resolution agent.
How to claim a class action settlement payment
Class members can file a claim online or download and print a PDF claim form and mail or email it to the settlement administrator. They may also request a claim form by calling 833-386-6591 or emailing info@OmniHealthcareSettlement.com.

What proof or documentation is necessary to submit a claim?
- For cash payment A (documented out-of-pocket losses), class members must provide proof, such as receipts, bank statements or other supporting documents showing the amount spent or lost due to the data incident. They may include self-made notes or explanations as supplementary information, but these cannot serve as the only evidence.
- For cash payment B (alternate cash payment) and medical data monitoring, class members do not need to provide documentation. They only need to select the appropriate option on the claim form.

Settlement fund breakdown

When is the Hammond et al. v. Omni Healthcare Financial Holdings, et al. payout date?
The settlement administrator will issue payments no later than 60 days after the court resolves any appeals and grants final approval to the settlement.
Why did this class action settlement happen?
The class action lawsuit claimed a cyberattack on Omni Healthcare’s network in January 2024 allowed an unauthorized third party to access files containing sensitive personal and medical information. The plaintiffs alleged Omni Healthcare failed to adequately protect this data.
The company denies any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
