
Individuals whom Nth Degree notified about a data breach that occurred in December 2024 or whose private information unauthorized individuals accessed or acquired as a result of that incident may qualify to claim up to $3,500 and/or credit monitoring from a class action settlement.
Nth Degree Inc. agreed to settle a class action lawsuit alleging it failed to adequately protect private information, which unauthorized individuals accessed during a cyberattack that occurred in December 2024. The compromised information included names, dates of birth and Social Security numbers belonging to approximately 38,953 current and former customers, contractors and employees.
Who can file a claim for a data breach payout?
Class members are individuals residing in the United states whose private information the Nth Degree data breach that occurred between Dec. 12, 2024, and Dec. 20, 2024, accessed or acquired, including those who received notice of the incident.
How much are settlement payments?
Class members have the following benefit options:
- Documented losses: Class members can claim up to $3,500 for unreimbursed documented monetary losses. Eligible expenses include bank fees, postage and fees for credit reports, credit monitoring or identity theft insurance purchased between Dec. 12, 2024, and July 30, 2026.
- Lost time: Class members can claim up to four hours of time spent dealing with the data breach at $20 per hour for a maximum of $80. Lost time is included in the $3,500 documented losses cap.
- Alternative cash payment: Class members who do not submit a claim for documented losses and/or lost time can submit a claim to receive a $50 alternate cash payment.
- Class members residing in California at the time of the data breach can submit a claim to receive an additional $100 cash payment.
- Credit monitoring services: All class members can elect to receive three years of single-bureau credit monitoring services, which includes dark web monitoring, up to $1,000,000 in reimbursement insurance and fully managed identity recovery assistance.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or use the same link to print a claim form to complete and mail to the settlement administrator.

Required proof and claim information
- To file an online claim, class members must provide the notice ID from the settlement notice they received and their last name.
- Documented losses claims require supporting documentation, which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges and other proof of identity theft or fraud.
- Lost time claims require a description of how they spent the time.

When is the Nth Degree data breach settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Nth Degree Inc. failed to adequately protect private information stored in its computer systems, which an unauthorized actor accessed or acquired during a cyberattack in December 2024. The plaintiffs claimed this failure resulted in the exposure of sensitive information.
Nth Degree denies any wrongdoing but agreed to settle to avoid the expense and risk of continued litigation.
