Individuals who owned a condominium at Metairie Towers Condominium complex at 401 Metairie Road, Metairie, Louisiana 70005 continuously from Aug. 29, 2021, through April 21, 2023, or who purchased a unit after Aug. 29, 2021, and owned it until April 21, 2023, may qualify to claim a share of a $650,000 class action settlement.

Scottsdale Insurance Co., Evanston Insurance Co. and Interstate Fire & Casualty Co. agreed to pay $650,000 to settle a class action lawsuit alleging mismanagement and misuse of insurance proceeds following Hurricane Ida and a subsequent water damage incident at Metairie Towers. The lawsuit claimed these actions caused financial harm to unit owners.

Who can file a Metairie Towers claim?

Class members must either have owned at least one condominium unit at Metairie Towers continuously from Aug. 29, 2021, through April 21, 2023, or acquired ownership of a condominium unit after Aug. 29, 2021, and owned it until April 21, 2023.

Those who owned more than one unit can claim for each unit, specifying whether each was a one-bedroom or two-bedroom unit.

Who is excluded from the class?

Unit owners who served as members of the board of directors of Metairie Towers Condominium Association during the period from Aug. 29, 2021, through April 21, 2023, are excluded from the class.

How much can class members get?

Pro rata payment: The total settlement fund is $650,000. The amount each eligible class member can receive depends on several factors:

  • The number of valid claims submitted
  • The number of units each claimant owned
  • Whether each unit is a one-bedroom or two-bedroom

After the settlement administrator deducts attorneys’ fees, expenses, a service award to the class representative and administration costs, it will distribute the remaining funds to eligible claimants on a pro rata basis. The allocation formula is based on the type of unit:

  • One-bedroom unit: 0.42905 share
  • Two-bedroom unit: 0.52968 share

Why is there a class action settlement?

The class action lawsuit alleged Metairie Towers Condominium Association, its board and related parties mismanaged and wasted insurance proceeds obtained after Hurricane Ida and a subsequent water damage incident. The plaintiffs claim this mismanagement led to insufficient funds to repair the property, causing financial harm to unit owners.

The settling insurers agreed to pay $650,000 to resolve these claims while not admitting any wrongdoing. The settlement is partial, and litigation continues against other parties.
