If you lived in Ohio, were a patient of Bon Secours Mercy Health, and logged into the Mercy MyChart portal between March 27, 2018, and December 31, 2021, you may be eligible submit a to claim for a $35 payment from a class action settlement.
Bon Secours Mercy Health has agreed to pay up to $7.5 million to settle a class action lawsuit alleging that patient information was improperly disclosed to third parties through its online platforms.
Who is eligible for Mercy Health privacy payout?
Class members must meet the following criteria:
- You are or were a patient of Bon Secours Mercy Health.
- You logged into the Mercy MyChart patient portal at any point between March 27, 2018, and December 31, 2021.
- You were residing in the state of Ohio at the time you logged into the Mercy MyChart patient portal.
How much can class action settlement payment?
Cash Payment: Class members can submit to receive a cash estimated at $35. The payment amount may be adjusted depending the number of valid claims filed.
How to claim a class action rebate
To receive a settlement payment, class members must submit a valid claim form. You can file a claim online or download and print the PDF claim form and mail it to the settlement administrator.

All claims must be submitted or postmarked by August 21, 2025.

$7.5 Million privacy class action settlement fund
The settlement fund of $7,500,000 million will include:
- Settlement administration costs: At least $200,000
- Attorneys' fees: Up to $2,100,000.
- Attorneys' expenses: To be presented to the court for approval at a later date
- Service award to class representative: Up to $18,000.
- Payments to approved claimants: Remaining settlement funds

When is the Mercy Health privacy settlement payout date?
Payments will be issued to valid claimants approximately 60 days after the court grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit alleged that Bon Secours Mercy Health disclosed personally identifiable and protected health information of patients who logged into the Mercy MyChart portal to third parties, including Facebook and Google, without authorization. Mercy Health denied these allegations and any wrongdoing, however agreed to settlement in order to avoid the risks and expenses involved in continuing litigation.
