Mercedes-Benz Emission Control System Settlement

Consumers who currently own or lease or previously owned or leased a Mercedes-Benz BlueTEC or Freightliner Sprinter BlueTEC II diesel vehicle from model years 2009 to 2016 that they registered in the United States may qualify to submit a claim for a $2,000 payment and free repair from a settlement facilitated by the Department of Justice.

Mercedes-Benz Group AG and Mercedes-Benz USA LLC agreed to settle a lawsuit alleging the emission control systems in certain diesel vehicles did not comply with emissions standards and violated the Clean Air Act and other state laws.

Who can file a claim for an emissions defect payment?

Individuals must meet one or more of the following criteria to qualify for an incentive payment:

  • They are a current owner or lessee of a qualifying Mercedes-Benz or Freightliner Sprinter BlueTEC II diesel vehicle, model years 2009-2016, and have not yet installed the approved emission modification but will install it by Aug. 31, 2026.
  • They are a current owner or lessee who installed the AEM on their eligible vehicle on or after Aug. 1, 2023.
  • They are a former owner or lessee who installed the AEM on their eligible vehicle on or after Aug. 1, 2023.
  • The eligible vehicle is operable and registered or held by a dealer in the United States or its territories.

  • E250 BlueTEC (2014-2016)
  • E350 BlueTEC (2011-2013)
  • GL320 BlueTEC (2009)
  • GL350 BlueTEC (2010-2016)
  • GLE300d (2016)
  • GLE350d (2016)
  • GLK250 BlueTEC (2013-2015)
  • ML250 BlueTEC (2015)
  • ML320 BlueTEC (2009)
  • ML350 BlueTEC (2010-2014)
  • R320 BlueTEC (2009)
  • R350 BlueTEC (2010-2012)
  • S350 BlueTEC (2012-2013)
  • Mercedes-Benz or Freightliner Sprinter (4-cylinder, 2014-2016)
  • Mercedes-Benz or Freightliner Sprinter (6-cylinder, 2010-2016)

Who is excluded from the class?

  • Anyone whose installed the AEM on the vehicle before Aug. 1, 2023
  • Anyone who already received a $2,000 incentive payment for a prior AEM installation incentive program after Aug. 1, 2023

How much are the Mercedes-Benz emissions incentive payments?

Cash payment: Qualifying current or former car owners can submit a claim to receive a $2,000 cash payment for each eligible vehicle.

How to claim a settlement payment

To receive a payment, eligible individuals must file a claim online. The claim deadline is Sept. 30, 2026.

Class members must complete the free AEM installation at an authorized Mercedes-Benz or Freightliner Sprinter dealership between Aug. 1, 2023, and Aug. 31, 2026, and before submitting a claim.

Required proof and claim information

  • All claims require:
    • The unique ID and PIN from the incentive program notice
    • A copy of the current vehicle title, a bill of sale if the class member no longer owns the vehicle or a lease agreement if they currently leases or previously leased the vehicle
    • The final repair order from an authorized dealer showing they installed the AEM between Aug. 1, 2023, and Aug. 31, 2026

When is the Mercedes-Benz emissions repair incentive payout date?

The settlement administrator will issue payments to approved claimants after it completes claim processing and the claim deadline passes.

Why is there an emissions defect settlement?

The U.S. Department of Justice alleged Mercedes-Benz violated emissions standards in certain diesel vehicles. Mercedes-Benz reached agreements with the DOJ, Environmental Protection Agency, California Air Resources Board and state attorneys general to provide free emission modifications and offer a financial incentive to encourage owners and lessees to install the modification.
