
Consumers who filed an insurance claim for structural damage to property in Missouri between June 5, 2012, and Aug. 12, 2025, in which Auto Club Family Insurance Co. withheld certain depreciation amounts may be eligible to claim a cash payment from a class action settlement.
Auto Club Family Insurance Co. agreed to resolve a class action lawsuit alleging it improperly deducted certain types of depreciation, specifically, nonmaterial depreciation, such as labor costs, when adjusting some structural damage insurance claims in Missouri.
Who can file a claim?
To qualify as a class member and file a claim, individuals must meet all of the following criteria:
- They filed an insurance claim for structural damage to property located in Missouri.
 - The damage occurred on or after June 5, 2012.
 - They made a claim under a Missouri homeowner’s insurance policy that Auto Club Family Insurance Co. issued.
 - Auto Club paid the claim, which included a deduction for nonmaterial depreciation (depreciation applied to costs other than materials, such as labor).
 - Auto Cub processed the claim using Xactimate or other computerized estimating software.
 - They submitted the claim between June 5, 2012, and Aug. 12, 2025.
 
Additional information
- The settlement also includes claims that would have resulted in a payment but for the withholding of nonmaterial depreciation, causing the loss to drop below the deductible.
 - Class members who have multiple qualifying claims (for example, more than one property or more than one loss), may need to submit a separate claim form for each qualifying loss.
 - Class members may have received a mailed notice if Auto Club’s records indicate their eligibility; however, those who did not receive a notice may still be eligible if they meet the above criteria.
 
Who is excluded from the class?
- Policyholders who received one or more actual cash value payments for a claim that exhausted the applicable insurance limits
 - Policyholders whose claims Auto Club Family Insurance Co. denied or abandoned without an ACV payment unless the only reason the withholding of nonmaterial depreciation caused the loss to drop below the deductible
 - Policyholders whose claims did not involve a computerized estimate (such as Xactimate) by Auto Club or its independent adjusters
 
How much can class members get?
Class members who submit a valid claim form can receive a cash payment. The amount depends on whether the claimant already recovered the full amount of nonmaterial depreciation previously withheld.
- Those who have not already recovered the full amount of nonmaterial depreciation are eligible to receive:
 - 100% of the value of the nonmaterial depreciation withheld from their ACV payment and not yet recovered
 - Plus interest at 5% per year from the date they received their ACV payment to the date of final approval
 
- Those who have already received compensation for all initially withheld nonmaterial depreciation are eligible for a flat payment based on the total amount of nonmaterial depreciation:
 - $25 if the amount was between $1 and $40,000
 - $50 if the amount was between $40,001 and $80,000
 - $75 if the amount was greater than $80,000
 
How to claim a class action payment
Eligible class members can file a claim online or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is Jan. 19, 2026.

What proof or documentation is required to submit a claim?
To file an online claim, class members must enter the notice ID included on the settlement notice they received. Those who did not receive the notice and believe they are a class member should contact the settlement administrator at 1-866-742-4955 or info@rg2claims.com.
All class members must provide their claim number, date of loss and policy number (those who received a settlement notice and claim form may may see these prepopulated).
Payout options
The settlement administrator will mail paper checks to eligible claimants at the address provided on the claim form.

 - Attorneys' fees and costs: Up to $399,000
 - Service award to class representative: Up to $5,000
 - Payments to eligible class members: Remainder of the fund

When is the Lyman v. Auto Club Family Insurance Co. payout date?
If the court grants final approval and the settlement administrator resolves all appeals, it will mail payments to eligible class members within 30 days after it completes the claims administration process.
Why did this class action settlement happen?
The class action lawsuit alleged Auto Club Family Insurance Co. improperly deducted depreciation for labor and other nonmaterial items when adjusting some structural damage insurance claims in Missouri.
Auto Club denied any wrongdoing but agreed to settle to avoid the cost and uncertainty of continued litigation.
