Why was there a class action settlement?
The class action lawsuit alleged Rust-Oleum Corp. labeled certain Krud Kutter products as "nontoxic" and "earth-friendly" when, according to the plaintiff, the products may cause harm to humans, animals and/or the environment. The Plaintiff also claimed consumers paid a higher price for these products based on the labeling.
Rust-Oleum denies these allegations and maintains the products are not toxic or harmful to the environment. Both sides agreed to settle to avoid the costs and risks of continued litigation.
