Current and former Hexpol employees who lived in the United States and received notice that a December 2024 data breach compromised their personal information may qualify to submit claim for up to $5,250 from a class action settlement. The cybersecurity incident compromised personally identifiable information, including names and Social Security numbers, belonging to approximately 1,723 individuals.

Hexpol Compounding Americas LLC and Hexpol Holding Inc. agreed to resolve a class action lawsuit alleging they failed to protect private information during a targeted cyberattack.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States whose personal information the Hexpol data breach discovered in December 2024 compromised, including those who received notice of the incident.

How much are settlement payments?

Class members have the following benefit options:

  • Documented losses: Class members can claim up to $5,000 in documented monetary losses traceable to the data breach. This includes unreimbursed losses due to identity theft or fraud, fees for credit monitoring or freezing/unfreezing credit paid on or after July 3, 2025, cost to replace IDs, postage from contacting financial institutions and fees or expenses related to tax issues.
  • Lost time: Class members can claim up to 10 hours of documented lost time spent dealing with tax-related issues the data breach caused at $25 per hour a maximum of $250.
  • Alternative cash payment: Class members who do not claim credit monitoring, documented losses and lost time can submit a claim to receive a one-time $70 cash payment.
  • Credit monitoring: All class members can elect to receive three years of CyEx Financial Shield Pro, which includes monitoring for fraud, unauthorized transactions and high-risk activity along with $1 million in identity theft insurance.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Class members must submit claims online or postmark them by June 15, 2026.

Required claim information and proof

  • To submit a claim online, class members must provide the unique ID and PIN from the settlement notice they received.
  • To submit a documented losses claim, class members must provie supporting documentation, which may include receipts, bank or credit card statements showing unreimbursed fees or fraudulent charges and any other proof of identity theft or fraud.
  • To submit a lost time claim, class members must provide third-party documentation showing time spent on tax-related issues along with a description of the activities.

Settlement fund breakdown

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: Up to $125,000
  • Service awards to class representatives: Up to $2,500 each ($5,000 total)
  • Credit monitoring: Cost determined by number of claims filed
  • Payments to approved claimants: Total determined by number and type of claims filed

When is the Hexpol data breach settlement payout date?
