Current and former residents of properties that FPI Management Inc. managed who received notification of a data security incident discovered around Aug. 14, 2020, may be eligible to submit a claim for up to $4,250 from a class action settlement.

FPI Management Inc. agreed to settle a class action lawsuit alleging it failed to protect current and former residents' personal information. The class action stems from an August 2020 cyberattack in which unauthorized parties accessed files containing sensitive data, including names, addresses, Social Security numbers, driver’s license numbers, passport numbers, financial account information and, in some cases, medical information.

Who is eligible to receive a data breach payout?

Class members must meet all of the following criteria:

  • They resided in the United States and are a current or former resident of a property managed by FPI Management Inc.
  • They received a notice from FPI Management Inc. or its authorized representative regarding the data security incident discovered on or about Aug. 14, 2020.

How much is the class action settlement payment?

  • Ordinary expense and time reimbursement: Up to $400 for out-of-pocket expenses and time spent dealing with the data breach
    • Expenses include bank fees, postage and fees for credit reports, credit monitoring or identity theft insurance services purchased between Aug. 14, 2020 and Nov. 6, 2025.
    • Time spent includes up to three hours at $20 per hour for a maximum of $60.
  • Extraordinary expense reimbursement: Up to $4,250 in documented unreimbursed monetary losses due to identity theft and related to the data incident that occurred between Aug. 14, 2020 and Nov. 6, 2025
  • California cash payment: A $100 cash payment for claimants who received notice of the data security incident at a California mailing address
  • Credit monitoring and identity protection services: All claimants can elect to receive an additional two years of free identity protection and credit monitoring services.

How to claim a class action rebate

Class members can submit an online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is Nov. 6, 2025.

Required proof and claim information

  • All claimants must provide the unique ID and PIN from their settlement notice.
  • Ordinary expense reimbursement claims require supporting documentation, such as receipts, bank or credit card statements and invoices for services.
  • Extraordinary expense reimbursement claims require proof of identity theft traceable to the data breach, including police reports, proof of falsified tax returns and documentation of other monetary losses.
  • Lost time claims require claimants to describe the activities and time spent.
  • For the California cash payment, the settlement administrator will verify it sent the notice to a California mailing address.

Class action settlement fund breakdown

The settlement fund includes:

  • Settlement administration costs: To be determined

  • Payments to approved claimants: Total determined by the total number and type of claims submitted

When is the FPI Management data breach settlement payout date?

The settlement administrator will issue payments to class members with valid claims 90 days after the court grants final approval of the settlement or within 30 days of the claim approval date, whichever is later.

Why did this class action settlement happen?

The class action lawsuit alleged FPI Management Inc. failed to protect the personal information of residents and former residents during a cyberattack in August 2020. The plaintiffs claimed this failure increased the risk of identity theft and violated several California laws, including the Consumer Privacy Act and Customer Records Act.

FPI Management denied the allegations but agreed to settle the class action to avoid the risks and expense of continued litigation.
