Individuals whose private information the May 2024 Express Services data breach potentially compromised may be eligible to claim up to $5,000 plus additional benefits from a class action settlement.

Express Services Inc. agreed to settle a class action lawsuit alleging a targeted cyberattack in May 2024 allowed unauthorized access to files containing private information. The lawsuit claims the breach exposed the sensitive data of individuals whose information Express Services stored.

Who can file a claim?

The settlement class includes individuals who meet all of the following criteria:

  • The May 2024 Express Services data incident potentially compromised their private information.
  • Files that threat actors may have accessed during the data incident contained their personal information.
  • Express Services’ records identify them as class members, and they received a notice about this settlement.

How much can class members get?

  • Out-of-pocket losses: Up to $800 for documented, unreimbursed expenses related to the breach. Eligible losses must have occurred between May 7, 2024, and Jan. 15, 2026, and may include:
    • Fees for credit reports or credit monitoring
    • Costs to freeze or unfreeze credit with any credit reporting agency
    • Costs to replace identification documents
    • Postage or mailing costs to contact financial institutions
  • Lost time reimbursement: Class members may claim up to four hours at $25 per hour (up to $100 total) for time spent responding to the breach, such as:
    • Changing passwords
    • Investigating suspicious activity
    • Researching the data incident
      • Class members must briefly describe their lost time on the claim form.
      • If claimed together with out-of-pocket losses, the combined total cannot exceed $800.
  • Losses for identity theft or fraud: Up to $5,000 for documented monetary losses directly resulting from the data incident. To qualify, the loss must be:
    • Likely caused by the Express Services data incident
    • Not already covered under out-of-pocket losses
    • Incurred between May 7, 2024, and Jan. 15, 2026
    • Supported by documentation showing efforts to mitigate or recover the loss, such as through insurance
  • Credit monitoring: Class members can elect to receive three years of credit monitoring services, which include:
    • Real-time credit file monitoring
    • Dark web monitoring
    • Public records monitoring
    • $1 million in identity theft insurance

No documentation is required for this option.

  • Alternative cash payment: A $75 one-time cash payment for class members who do not claim any other monetary reimbursement. No documentation is required for this option.

How to claim a settlement payment

Class members must submit a claim form by the Jan. 15, 2026, deadline. They can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

What proof or documentation is required to submit a claim?

  • All claimants must provide the unique ID from their settlement notice to submit a claim online.
  • To claim reimbursement for out-of-pocket expenses or identity theft losses, class members must provide documents, such as receipts, invoices, bank statements or other records showing the amount spent or lost.
  • For lost time reimbursement, class members must attest to the time spent and briefly describe the tasks performed.
  • For the $75 alternative cash payment, no documentation is required; class members only need to select that benefit.

Express Services data breach settlement fund

The settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys’ fees, costs and expenses: Up to $222,500
  • Service awards to class representatives: Up to $9,000 total
  • Credit monitoring services: Determined by number of valid claims
  • Payments to eligible class members: Determined by number of valid claims

Important dates

  • Opt-out deadline: Dec. 16, 2025
  • Deadline to file a claim: Jan. 15, 2026
  • Final approval hearing: Jan. 21, 2026

When is the Express Services data breach settlement payout date?

The settlement administrator will distribute payments to class members with valid claims approximately 30 days after the court grants final approval of the settlement and resolves any appeals.

Why is there a class action settlement?

This class action lawsuit alleged Express Services experienced a targeted cyberattack in May 2024 that allowed unauthorized access to files containing private information. The plaintiffs alleged that Express Services failed to implement adequate cybersecurity safeguards to protect that information.

Express Services denies any wrongdoing but agreed to settle to avoid the costs, risks and uncertainties of continued litigation.
