Who can file a claim for a data breach payout?

Class members are individuals residing in the United States who received written notification from Etairos Health about the data breach on or around March 22, 2024.

How much are settlement payments?

Class members have the following benefit options:

Reimbursement for out-of-pocket losses and attested time: Class members can claim up to $4,500 for out-of-pocket losses that occurred on or after Feb. 20, 2024, including up to $120 for time spent responding to the breach.

Eligible out-of-pocket expenses include costs for accessing or freezing/unfreezing credit reports, credit monitoring fees, postage for contacting financial institutions and monetary losses due to identity theft, fraud or falsified tax returns.
Class members can claim up to eight hours of lost time at $15 per hour ($120 maximum).

Alternative cash payment: Class members who do not submit an out-of-pocket losses or attested time claim can submit a claim to receive an alternative cash payment of $75.
Credit monitoring services: All class members can elect to receive three free years of three-bureau credit monitoring and identity theft protection services. This includes dark web scanning with user notification, identity theft insurance, real-time credit monitoring and access to a fraud resolution agent if needed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

The claim deadline is Dec. 21, 2026.

Required proof and claim information:

To submit a claim online, class members must provide the login ID and PIN from the settlement notice they received.
To submit a claim by mail, class members must provide the login ID from the settlement notice they received or the name and physical address they provided to Etairos for employment.
To submit an out-of-pocket losses claim, class members must provide supporting documentation, which may include receipts, bank or credit card statements and other proof of fraud or identity theft.
To submit a lost time claim, class members must provide a description of time spent responding to or mitigating the effects of the data breach.

Settlement fund breakdown

The settlement fund will include:

Settlement administration costs: To be determined
Attorneys' fees and costs: Up to $146,500
Service award to the representative plaintiff: Up to $3,500
Credit monitoring: Cost determined by the number of claims and enrollments
Payments to approved claimants: Total determined by the number of valid claims filed

Important dates

When is the Etairos Health data breach settlement payout date?

The settlement admnistrator will issue payments to approved claimants within 90 days of the final approval date or within 30 days of the claim approval date, whichever is later.

Why did this class action settlement happen?

The class action lawsuit claimed an unauthorized individual accessed Etairos Health Inc.'s systems and acquired the personally identifiable information of current and former employees in February 2024. The plaintiff alleged Etairos failed to take appropriate care to protect this information and claimed negligence and breach of implied contract.

Etairos denies the allegations but agreed to settle to avoid the cost and uncertainty of a trial.
