
If you lived in the United States and your personal information was affected by a cybersecurity incident involving Estrella Franchising, LLC d/b/a Estrella Insurance in January 2025, you may be eligible to submit a claim for up to $5,000 or other benefits from a class action settlement.
Estrella Insurance has agreed to pay to settle a class action lawsuit regarding alleged failures to protect personal information during a cybersecurity incident that occurred in or around January 2025.
Who is eligible for a data breach payout?
Class members must meet the following criteria:
- They reside in the United States.
- Their personal information was accessed as a result of the cybersecurity incident experienced by Estrella in or around January 2025.
How much is the Estrella Insurance settlement payment?
Class members can claim one or more of the following:
- Credit Monitoring Services: One year of single-bureau credit monitoring and identity protection services, including $1,000,000 in identity theft insurance.
- Class members that previously signed up for free credit monitoring provided by Estrella Insurance may still claim this benefit.
- Ordinary Losses: Class members may submit for up to $1,000 for documented, out-of-pocket expenses incurred between January 22, 2025, and seven days after the court-approved notice was sent to the class. Eligible expenses include:
- Unreimbursed bank fees
- Postage or gasoline for local travel
- Fees for credit reports, credit monitoring, or identity theft insurance purchased as a result of the incident
- Lost Time: Class members may submit to receive $25 per hour for up to 4 hours for time spent dealing with issues related to the incident, a total of $100.
- Extraordinary Losses: Class members may submit for up to $5,000 per claimant for documented, unreimbursed monetary losses caused by misuse or fraud involving your personal information. The financial loss should be traceable to the data incident, occurred within the specified period, and is not already covered by the ordinary loss or lost time categories. Losses may include:
- Fees paid to an attorney or CPA for falsified tax returns
- Unreimbursed bank or credit card charges due to fraud
How to claim a data breach class action rebate
To receive a settlement payment, a valid claim must be submitted. Class members can file a claim online or complete and mail the paper claim form included with the settlement notice to the settlement administrator.

Required proof and information
- Notice ID required to submit an online claim.
- Ordinary losses claims require supporting documentation such as receipts for fees and bank or credit card statements.
- Extraordinary losses claims require proof such as police reports, invoices or receipts for attorney or CPA services, and documentation showing fraudulent charges traceable to the data breach.

Data breach class action settlement fund breakdown
The settlement fund will include:
- Settlement administration costs: To be determined
- Attorneys' fees and expenses: Up to $125,000
- Service awards to class representatives: Up to $1,250 each, $2,500 total
- Credit monitoring and identity theft services: Cost determined by number of claims filed
- Payments to approved claimants: Total determined by the number of valid claims filed and approved

When is the Estrella Insurance settlement payout date?
