Dufresne Spencer Group LLC, which operates Ashley Furniture HomeStore, agreed to settle a class action lawsuit alleging it failed to adequately protect sensitive personal information, resulting in unauthorized access to private information.
Who can file a claim?
Class members are individuals in the United States whom Dufresne Spencer Group sent written notification stating the data incident that occurred between May 15, 2023, and June 5, 2023, potentially impacted their private information.
How much is the class action settlement payout?
- Reimbursement for out-of-pocket costs, lost time and extraordinary losses:
- For documented out-of-pocket losses: Class members may claim up to $500 for documented, unreimbursed out-of-pocket expenses incurred as a result of the data incident. Eligible expenses include unreimbursed bank fees, certain cell phone and data charges, postage, gasoline for local travel, and fees for credit reports, credit monitoring or identity theft insurance purchased between May 15, 2023, and March 19, 2026.
- For attested lost time: Class members may claim reimbursement for up to four hours of time spent addressing issues related to the data incident at a rate of $20 per hour (for a maximum of $80). They must attest that they spent at least one full hour on eligible activities. Class members can combine reimbursement for lost time with out-of-pocket losses, but the combined total may not exceed $500.
- For documented extraordinary losses: Class members may claim up to $2,500 for actual, documented and unreimbursed monetary losses the data breach most likely caused. Claimants must show that the losses occurred between May 15, 2023, and March 19, 2026, and that they exhausted all available insurance coverage for the losses.
- Alternative cash payment: In lieu of submitting claims for out-of-pocket losses, lost time or extraordinary losses, class members may elect to receive a $45 cash payment. Those who select this option are not eligible to claim other monetary reimbursement categories.
- Credit monitoring services: All class members may elect to receive two years of three-bureau credit monitoring services, which includes dark web monitoring and up to $1,000,000 of identity theft insurance.
How to claim a class action payment
To receive a settlement payment or credit monitoring services, class members must submit a valid claim form. They may file a claim online using the unique ID and PIN provided in the notification letter they received or print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is March 19, 2026.

Required proof and claim information
- For all claims, class members must provide their contact information and the unique login credentials included in their settlement notice.
- For out-of-pocket loss reimbursement, class members must provide reasonable third-party documentation of actual, unreimbursed expenses related to the data incident.
- For lost time reimbursement, class members must attest to the time spent and provide a description of the activities performed.
- For extraordinary loss claims, class members must provide documentation showing the data breach most likely caused the loss and that they exhausted available insurance coverage. Self-prepared documents alone are not sufficient.
- For the alternative cash payment and credit monitoring services, class members do not need to submit documentation of losses but must submit a valid claim form.
