If you received a notice that your private information was accessed during the November 2024 Concord Orthopaedics data breach, you may be eligible to claim up to $3,000 from a class action settlement.

Concord Orthopaedics Professional Association has agreed to settle a class action lawsuit that arose after a targeted cyberattack in November 2024 that affected 72,815 people.

The lawsuit alleges that Concord Orthopaedics failed to adequately protect sensitive personal information, including names, dates of birth, Social Security numbers, appointment details, health insurance information and driver’s license or state identification numbers.

While Concord Orthopaedics denies any wrongdoing, the settlement allows affected individuals to receive compensation and identity protection services without the uncertainty and expense of ongoing litigation.

Who can file a Concord Orthopaedics data breach claim?

The official settlement website defines the class as:

  • Anyone who received a notification from Concord Orthopaedics that their information was compromised in the November 2024 data breach is considered a class member.
  • The class includes both adults and minors whose information was accessed, as well as any other individuals whose data was identified in the breach.

How much are the data breach settlement payouts?

Class members can claim several types of benefits and/or payouts depending on their circumstances and the documentation they provide.

  • Documented Losses: Up to $3,000 for actual, documented out-of-pocket losses related to identity theft or fraud resulting from the data breach. Eligible expenses include:
    • Losses from identity theft or fraud
    • Fees for credit reports, credit monitoring, or freezing/unfreezing credit
    • Costs to replace IDs
    • Postage for contacting banks or other institutions
  • Lost Time: Up to four hours at $25 per hour (maximum $100) for time spent responding to the breach, such as changing passwords, investigating suspicious activity, or researching the data breach.
  • Alternate Cash Payment: A one-time $50 payment is available as an alternative to the lost time claim.
  • Medical Shield Monitoring: One year of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance and monitoring for healthcare insurance ID exposure, medical record number exposure and unauthorized health savings account spending.

Class members may claim either the lost time payment or the alternate cash payment, but not both. Those who claim reimbursement for documented losses may also claim either lost time or the alternate cash payment.

Payout calculation examples

  • If a class member provides documentation for $2,000 in out-of-pocket losses, they can claim the full $2,000 (up to the $3,000 cap).
  • If a class member spent three hours responding to the breach, they can claim $75 for lost time (3 x $25).
  • If a class member does not have documentation or did not spend time responding, they can claim the $50 alternate cash payment.

How to claim settlement benefits & payouts

To receive compensation or benefits, class members must submit a claim form by July 8, 2026. The fastest way to file is through the online claim form. Alternatively, you can download a PDF claim form and mail it to the settlement administrator.

Documentation required for losses

Documented Losses require attached proof such as bank statements, receipts or other supporting documents is required. Self-prepared notes alone are not sufficient. To claim this benefit, you must provide documentation such as bank statements or receipts. Self-prepared notes can be submitted to support other documentation but are not sufficient on their own.

No documentation is required for lost time claims, but claimants must attest to the time spent.

To help ensure your claim is processed smoothly, follow these steps:

  1. Visit the online claim form or download the PDF claim form.
  2. Enter your name, address, email and phone number. Include your class member ID if you know it.
  3. Select the benefits you wish to claim: Medical Shield Monitoring, reimbursement for documented losses, lost time or alternate cash payment.
  4. If claiming documented losses, list each expense and attach supporting documentation.
  5. Choose your preferred payment method: PayPal, Venmo, Zelle, virtual prepaid card or physical check.
  6. Sign and date the claim form, attesting that the information is true and correct.
  7. Submit the claim form online, by email to info@ConcordDataSettlement.com or by mail to the settlement administrator at the address above.

What are the payout options?

Class members can choose from:

  • PayPal (provide email address)
  • Venmo (provide mobile number)
  • Zelle (provide email or mobile number)
  • Virtual prepaid card (provide email address)
  • Physical check (mailed to the address provided)

Settlement fund distributions

The settlement fund will cover:

  • Attorneys' fees and costs: $200,000 (to be paid by separately by Concord Orthopaedics)
  • Service awards to class representatives: $1,500 each
  • Payments to class members: Amounts for documented losses, lost time, alternate cash payments and the cost of Medical Shield Monitoring

When is the Concord Orthopaedics data settlement payout date?

What happens next?

The court will hold a final approval hearing on June 23, 2026. If the settlement is approved and there are no appeals, payments and benefits will be distributed to eligible class members who submitted valid claims.
