Progressive Direct Insurance Co. or Progressive Preferred Insurance Co. customers in Colorado and whose vehicle(s) the companies declared a total loss during certain periods may qualify to submit a claim to receive a cash payment from a class action settlement.
Progressive Direct Insurance Co. and Progressive Preferred Insurance Co. agreed to pay $15.24 million to settle a class action lawsuit alleging they underpaid policyholders on total loss vehicle claims by applying an improper projected sold adjustment to the actual cash value of vehicles.
Who can file a claim for a Progressive auto insurance payout?
Individuals must meet the criteria of one or both of the two settlement classes:
- Progressive Direct class:
- Individuals who made a first-party claim for property damage to a motor vehicle on a personal automobile insurance policy Progressive Direct Insurance Co. issued to a Colorado resident
- Submitted a claim between April 12, 2019, and July 8, 2026
- Progressive Direct determined the vehicle was a total loss and based its claim payment on an instant report from Mitchell in which it applied a projected sold adjustment to at least one comparable vehicle.
- Progressive Preferred class:
- Individuals who made a first-party claim for property damage to a motor vehicle on a personal automobile insurance policy Progressive Preferred Insurance Co. issued to a Colorado resident
- Submitted a claim between Dec. 19, 2021, and July 8, 2026
- Progressive Preferred determined the vehicle was a total loss and based its claim payment on an instant report from Mitchell in which it applied a projected sold adjustment to at least one comparable vehicle.
How much are settlement payments?
Cash payment: Class members can submit a claim to receive a cash payment equal to 68% of the projected sold adjustment impact amount for their total loss claim. The settlement administrator will calculate the PSA impact amount as a percentage of the actual cash value of the total loss vehicle, depending on which class the individual submits the claim under:
- Progressive Direct class: PSA impact amount is 2.75% of the ACV.
- Progressive Preferred class: PSA impact amount is 2.25% of the ACV.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or use the same link to print a personalized claim form and mail it to the settlement administrator.

When is the Progressive Colorado auto insurance settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement and resolves any appeals.
Why did this class action settlement happen?
This class action settlement resolves allegations that Progressive Direct Insurance Co. and Progressive Preferred Insurance Co. underpaid policyholders on total loss vehicle claims. The plaintiffs claimed Progressive used valuation reports from Mitchell that applied a projected sold adjustment that reduced the actual cash value paid on total loss claims.
Progressive denies the allegations but agreed to settle to avoid the expense and risk of further litigation and a possible trial.
