Neuromusculoskeletal Center of the Cascades PC and Cascade Surgicenter LLC have agreed to resolve a class action lawsuit stemming from a targeted cyberattack on their computer systems in October 2023. The attack resulted in unauthorized access to files containing sensitive personal and medical information, including names, contact details, Social Security numbers, financial account information, medical records, and more.
Who is eligible for a data breach payout?
Class members are individuals who received written notification from Neuromusculoskeletal Center of the Cascades PC or Cascade Surgicenter LLC stating that their personal information was compromised in the data incident that occurred on or around Oct. 2, 2023.
What are the settlement benefits?
- Option 1: Class members can submit a claim for one or more of the following:
- Medical Data Monitoring Services: Class members can elect to receive two years of CyEx Medical Shield Total, which includes $1 million in medical identity theft insurance and monitoring for healthcare insurance ID exposure, medical record number exposure, and unauthorized health savings account spending.
- Out-of-Pocket Expenses: Class members can claim up to $500 for actual, documented expenses incurred as a result of the data incident. Eligible expenses include fees for credit reports, credit monitoring, freezing/unfreezing credit, costs to replace IDs, and postage to contact banks.
- Losses from Identity Theft or Fraud: Class members can claim up to $2,500 for documented losses due to identity theft or fraud that are traceable to the data incident and not already covered by out-of-pocket expenses. Claimants must show they attempted to recover the loss, such as through a bank or credit card dispute or insurance.
- Payment for Lost Time: Class members can submit to receive payment for up to four hours of time spent dealing with the data breach, at $25 per hour, for a maximum of $100. This includes time spent changing passwords, investigating suspicious activity and researching the incident.
- Option 2: Alternative Cash Payment
- Class members that do not submit for any Option 1 benefits can claim a one-time $80 cash payment.
How to claim a data breach class action rebate
To receive a settlement payment, a claim form must be submitted. Class members have the following options:
- Submit an online claim
- Print the PDF claim form and mail it to the settlement administrator
- Email an electronic image of the claim form to the settlement administrator

Required proof and claim information
- Unique ID and PIN required to submit an online claim.
- Out-of-pocket expenses claims require supporting documentation such as receipts and invoices for services.
- Identity theft or fraud losses claimants must show proof of loss and that it was likely caused by the data incident. This may include bank or credit card statements showing fraudulent charges, police report, proof of falsified tax returns or other documentation showing identity theft.

Data breach settlement fund breakdown

Why did this class action settlement happen?
The class action lawsuit was filed after a targeted cyberattack in October 2023 allowed unauthorized access to files containing personal and medical information held by Cascade. Plaintiffs claimed that the defendants failed to adequately protect this information.
Cascade denies these allegations but agreed to settle to avoid the expense and uncertainties of continued litigation.
