California residents who used chooseketamine.com or chooseyourhorizon.com between May 9, 2023, and July 11, 2024, may be eligible to claim approximately $261 from a class action settlement.

Choose Your Horizon Inc., a ketamine therapy provider, agreed to pay $400,000 to settle a class action lawsuit alleging it disclosed confidential customer information to third parties in violation of California privacy law.

Who are the class members?

The settlement class includes all individuals who meet the following criteria:

• They are residents of California.
• They used the websites chooseketamine.com or chooseyourhorizon.com.
• They accessed these websites between May 9, 2023, and July 11, 2024.
• Choose Your Horizon disclosed their personally identifiable or protected health information to third-party entities after they used the websites while located in California.

How much can class members get?

Each eligible class member is entitled to an equal (pro rata) share of the $400,000 settlement fund. After deducting attorneys’ fees, service awards and administrative costs, the anticipated payment per class member is approximately $261. The actual amount may vary depending on the number of valid claims and exclusions.

How to claim a class action payment

Class members who received a notice by mail do not need to file a claim; the settlement administrator will automatically send payments to the address on file. Class members who need to update their address can do so on the settlement website. They can select their payment preference at the same link or when submitting a claim.

Class members who did not receive a notice by mail but believe they are eligible must submit a claim form. They can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator.

$400,000 million settlement fund breakdown

When is the Choose Your Horizon Inc. settlement payout date?
